So back in October I got a notice like many of you did that Amazon released my information to the state of California because I had FBA inventory sitting in a California warehouse. I ignored it as I have most things dealing with internet sales tax until the dust settles and a clear system is put in place.
Well, today I got the big letter from the state of CA stating that because I have inventory there I’m now required to register with them by January 15th or they will take away my first born or something.
I called in and the rep I spoke to said (without chuckling) that I would need to contact all of my customers who purchased items in the state of CA and see if they paid the sales tax on it. If they did not I would be required to remit it. I asked him if he realized how ludicrous that sounded and he replied back that he doesn’t make the rules…
I’m all for following the rules but how is a small business supposed to accomplish this? I would need a team of accountants to handle the 12,000+ taxing jurisdictions across the country.
I was hoping I could stick my head in the sand until some law that made sense got passed but it appears that is not the case.
I believe that may violate Amazons rules for contacting buyers: In general, you can contact buyers only to complete orders or to respond to customer service questions.
At the very least it would probably not sit well with the buyer who may take it out on your feedback metrics.
I wonder if it’s time to boycott California. Refuse to ship any FBA items to California warehouses. Maybe even recall all items that are currently there. If everyone would do it Amazon might fight a little harder for us.
You might be able to compile a spreadsheet of orders that sorts orders into CA zip codes there you can lookup if tax was paid on the orders.
One more reason NOT to use FBA.
Now on top of employees stealing your inventory, overseas reps abusing refunds w/o returns, customers swapping items, and Amazon FBA contract saying you have to allow up to 20% shrinkage, CA gets a piece of you.
I’m willing to sell my “nexus” in CA to pay for the supposed sales tax I owe. Anyone need a few million square feet warehouses? Going cheap
Is there a way to look up where your FBA items are stored? How?
I got a letter from them early in the year. Jumped through all the hoops. Filled out the info–had to fake some of it in order to fool the system (I never understood this part because if what they are doing is legal, then why do we have to “fool the system”). Did all I was suppose to. I have never heard back from them.

Best Answer In That Thread IMO…
