I am beyond frustrated with Amazon’s handling of repeated wrongful infringement claims against my product, the Professional Smart Cupping Massager with Remote (ASIN B0CF5FNSXR). This situation is not only unacceptable but also outright harmful to my business.
Let me be clear: the initial claim was proven unfounded. Amazon reinstated my listing with this exact statement:
"We removed listing restrictions and the Account Health policy violation record for the following content:
ASIN: B0CF5FNSXR
Complaint ID: 16723183731
In our efforts to protect our customers, we sometimes err on the side of caution. We apologize for any inconvenience this has caused."
Yet here we are again. My product was flagged a second time (Complaint ID: 16854081351) for the exact same baseless claim during the most crucial sales period of the year—right before Black Friday and Christmas. This is not a coincidence. Competitors are abusing the infringement system to sabotage sellers like me, and Amazon’s lack of action makes it complicit in these tactics.
I’ve done everything to resolve this:
Submitted a detailed Comparison and Analysis Document outlining the clear differences between my product and the complainant’s.
Provided a Letter of Non-Infringement from my attorney confirming no overlap in functionality, design, or purpose.
Despite all this, my appeal has been sitting unresolved for over three weeks. Meanwhile, my business is bleeding sales in the most profitable season of the year.
Amazon’s failure to act promptly enables malicious brands to manipulate the system and monopolize sales during peak periods. This isn’t just negligence; it’s actively harming honest sellers.
To Amazon: escalate this matter immediately and reinstate my product without delay. Your platform cannot continue to punish legitimate sellers while rewarding bad actors.
To fellow sellers: Has anyone dealt with this level of negligence? How did you force Amazon to take action? I refuse to let my business suffer in silence.
