Was this small claims court? I believe Amazon's terms allow for that to bypass arbitration.

Yes, small claims.
I was dreading this so much and having all kinds of anxiety because of everyone on these forums always putting people down for wanting to sue and yelling at them that Amazon cannot be sued because of agreement blah blah.
Turns out, it’s actually much easier and cheaper than I ever expected.
Case was for inventory that they shipped to my old address and refused to reimburse for, citing their contract and that they are not liable.
Judge thought otherwise.
Their lawyer tried to force me into arbitration and tried to limit any future similar cases to be covered by this one small claims outcome. Judge thought otherwise on all of this as well.
I guess it would ultimately depend on the courts and the judge handling the case…. I filed in my local court and their attorney attended the hearting via zoom.
This should be able to be used as a reference for other attorneys in future cases.

Did you represent yourself or did you hire an attorney? Can you give us a general idea of what your costs were?

The trick is to sue in small claims court and then let their lawyers request to move it to a higher court. By requesting the move, they should be considered as consenting to the case being heard in that court. Otherwise, in small claims court, they should be required to have a non-lawyer party represent the company. At least, that’s how it would work here in Michigan.
