Hi, I have received a false patent infringement. Where My product does not represent their product. The product I am private labeling and manufacturing from China is the purple board attached.
and black color plank trainer called abmill is the patented product that they suspected me of infringing. (Which is completely different)
The Amazon notice asked for a retraction from right owner, court order, or a letter of non infringement. I sent Two appeals of a letter of non infringement that got rejected. Now they asked for a court order or a retraction of the owner. I emailed the owner and they said they believe this product infringes on the patent. I seeked legal advice and they told me to file a patent. I tried filing for a patent for this product as if that would do anything. Even though patent-pending has no legal power. Also I don't think my patent application went through as I cannot find my patent application for some reason. Now do I really have to go to court and waste so much just to prove this is false. It is evident that the product is not the same.
Additionally I am suspecting illegal price gouging is going on where the sellers are restricting competition.
The product I tried to sell is a Pilates board. If you search up this keyword in Amazon you can see Sales is amazing and competition is extremely low. There used to be 10+ sellers sellers selling this product but now there is only 2. I am assuming that the others got a violations as well. If I was infringing on a patent wouldn't the two other sellers be taken down too. These two sellers are selling this product at a really high price. To manufacture this board is relatively cheap but these guys are selling it high.
Please Mods or anyone can help. I have inventory stranded and removal fees will be quite high as its a oversize product
Also can I do anything to avoid the removal fees?
Can the mods contact the support and have a deeper review of my situation
