Help with Deactivated Account Due to Repeated Restricted Product Violations

Hey everyone,

I'm dealing with a frustrating situation where my US Amazon seller account has been deactivated due to three high repeat Restricted Product Policy Violations:

  • ASIN: B00RWMGBOI (Case ID: 14232622321) - Violation Date: Nov 3, 2023
  • ASIN: B079H9Z3D9 (Case ID: 14225338471) - Violation Date: Nov 2, 2023
  • ASIN: B07B53M8J6 (Case ID: 14153815851) - Violation Date: Oct 17, 2023

The violations were due to product images being in Japanese, which didn't meet the FDA's labeling requirements for U.S. consumers.

Here's the complication:

  • These products have been out of production for over 3 years and out of the U.S. market for an extended period.
  • I've already removed these listings from my inventory after receiving the violations, but I'm not the brand or listing owner, so I couldn't update the listings before removal.
  • Since my account is now deactivated, I can't dispute the violations directly; I can only submit a Plan of Action through my case. However, each time I've submitted a plan of action, I receive the same response: "Deleting your listings on the affected ASINs however does not sufficiently address the reason for the violation and will not result in the violation removal from your 'Account Health' page."

I've been appealing since November 2023, but I'm at a standstill. These violations are over a year old, and I'm out of options to directly address them since I can't add or modify products with a deactivated account.

Does anyone have experience with this kind of situation? How can I move forward to get my account reactivated?

They want an appeal, not you telling them "hey, it was 3 years ago that I violated US law and I deleted them when you caught on to it"

Your only, slim shot, is to take full responsibility, read up on and understand how you broke the law, apologize and beg for mercy.

Please do not provide a written appeal in these situations, they will not help is verifying compliance and as you've experienced they will only be rejected. Restricted products can only be disputed in these situations. If it was a simple listing update you can explain the situation, but with this being an FDA labeling issue, we will require proof that these products never violated our policies.

As mentioned this is a dispute only scenario so if these documents do not exist the account will no longer be eligible for reactivation.
