Hi everyone,
I'm about to start the process of applying for a trademark and enrolling in brand registry after selling on Amazon for 2 years. I know a lot of people get their applications rejected so I want to make sure I do this right. Forgive me for my naivete and ignorance regarding this subject but there are a few things I'm confused about.
I will be registering for a standard word mark for the trademark. Currently my brand name on Amazon is one word with the first letter capitalized and the rest of the word in lowercase.
1) Does the capitalization that I have for my brand name which was brand approved a few years ago have to match the capitalization I use for my trademark and what I enter for brand registry?
2) If I am only registering for a standard word mark (not a design mark), does my logo need to match the exact capitalization of my trademark? For example, my logo is in all capitalization but only the first letter of my trademark will be capitalized.
3) I have the word "Interior" in small text underneath my brand name for my logo, so that when customers see our logo they know we specialize in home decor products. Is the word "interior" underneath my brand name going to be a problem for the logo since we are not including "interior" for the trademark? I see sellers who have a standard word mark for their trademark and they will have words added to their logo such as "home decor", "home", "interior" when it is not included in their brand name.
I'd appreciate any clarity to help my brand registry process go as smoothly as possible, thanks.

You are asking here other sellers. On your place I would not rely on answers coming from dilettants (like me, for example). Neither can seller support answer. You should consult a trademark attorney.
The only thing for sure is that your trademarked brand has to match EXACTLY with what you used on Amazon if you want to continue on Amazon with your EXISTING listings. If your USPTO trademark differs one iota you will have to create new listings.
In addition to what @Seller_rI7BZIczK8iAC has noted, here is a template that I post for people AFTER they have problems.
It might help since you haven't started yet!
Here are some of the most common issues with BR.
Go over everything with a magnifying glass looking for a missing 'period' or 'comma'.
Is there a different capitalization, abbreviation, spelling, or, even an extra spa ce?
Is your Brand registered (or applied for) with the USPTO?
Amazon is admitting applicants under CERTAIN conditions when only filed but not granted.
This is from Sandy_Amazon on 5/16/2023
“To be eligible for Amazon Brand Registry, your brand must have an active registered trademark in each country where you wish to enroll or have a pending trademark application filed through Amazon IP Accelerator. Brand Registry is also accepting brands that have a trademark pending registration in a subset of trademark offices.”
Additionally, IF you ever get an actual TM (if you don’t now) When Amazon says something must match they mean EXACTLY!
That means Street is not ST.
Jim is not James.
ALL CAPS is not SOme CAps
Thanks to Sandy_Amazon for letting us all know that Brand Registry applications are also space sensitive.
And so on………………..
They mean every comma, period, dash, etc. must be EXACTLY THE SAME INCLUDING SPACE S.
Go over everything with a magnifying glass looking for a missing 'period' or 'comma'. Is there a different capitalization, abbreviation, spelling, or, even an extra spa ce?
What is the EXACT BRAND (as GRANTED) on the USPTO site? Is it the EXACT same as the Brand on the Amazon account AND the brand on the packaging?
What is the name of the Owner (REGISTRANT) on the USPTO site? Is it the EXACT same name as the owner of the Amazon account?
If it is NOT exactly the same you will need to show some proof that the two are the same. As I recall, I had to submit my LLC State Registration with MY name as the owner of the LLC since my Amazon account is under a different LLC name.
The OWNER of the Brand is the one that MUST enter into the Brand Registry agreement. If the owner is not the same as the Amazon seller the seller will have to be granted access by the owner AFTER REGISTRATION.
Hello @Seller_X0EpnXooluuab
My name is JiAlex from the Community Manager team here on forums. I wanted to follow up on your post. In regard to your inquiry, Brand Registry sources, the business name from the USPTO website and hence any incomplete or inaccurate information on the USPTO website (Including brand name and logo -capitalizing-) associated with your trademark may negatively impact your application.
For example, if we could not verify the registered business name and business identifier (e.g. tax ID number or business ID number) provided by you at the time submitting the Brand Registry enrollment form. If the name of the business owning the trademark is incorrectly updated on the USPTO website, please make sure you update the business information correctly on the USPTO website first before submitting your new Brand application.
Please review the application requirements closely and our application guide before try to apply with Brand registry.
Any assistance, don’t hesitate to reach out our support channel.

Brand Registry is A LOT of money and hoops to jump through. If you're doing it for enhanced brand content / A+ content then it's worth it. If you're doing it to protect your brand, well don't bother..because it's an illusion that breaks down the moment you attempt to enforce it and use the reporting tool.

I strongly recommend you get a lawyer to register your trademark. To register yourself is 250 and with a lawyer 850 but a lawyer can save you from a lot of potential problems, delays, refusals etc
