My Seller account has been deactivated due to Restricted Product Policy

Dear All,

My Amazon Seller Account has been deactivated due to the Restricted Product Policy. I send a POA. But every time it gets rejected I receive response from Amazon that "Your account will not be reinstated without proof of compliance with our policies. I have contacted Account Health Support Specialist. They suggested I to "dispute the violation".

I do not know how to dispute the violation and what to do next. Please suggest me.

Thank you for allowing me to provide information regarding the “Restricted Product Policy Violation,” due to which my seller account has been deactivated.

  • My seller account has been deactivated because of the violation of the “Amazon Restricted Product Policy”. Because I had listed an item (ASIN: B01176A45G) that comes under the Restricted Product Category of Amazan.
  • I had listed this item (ASIN: B01176A45G) through mapping. Because this product was listed by another seller and was live on amazon.com. I had not created this ASIN (I am not an ASIN creator of this item).
  • I was not aware of the way this ASIN was created, and I mapped it and listed it on my Amazon Seller Account. Since this item was already available on Amazon for sale and was active on Amazon, I listed it without doing an in-depth investigation of this item.
  • As we know many products are not allowed on Amazon. But when I saw this product listed on Amazon, I understood that this product does not violate Amazon's restricted product policy so this product is available on Amazon. I did not know that the ASIN creator of this product has created it in such a way that it was not easy to detect.

I have Prepared the following POA.

I would like to appeal of our Account reinstatement and allow us to sell again on the Amazon.com platform.

Please find the detailed plan of action for the Amazon.com Account suspension issue:

Root Cause Analysis-

My Amazon.com seller account is suspended because I have received a notification from the product review team stating that “you have listed items that are not permitted for sale on Amazon and come under "Restricted Products" category.

Root Cause:

My Account is suspended because I received " Restricted Products " Complaints on 13th March 2024 from Amazon seller Performance team for the ASIN: B01176A45G.

ASIN: B01176A45G product has been identified as a restricted product, which can’t be sold without a medical prescription or professional supervision or is not permitted to sell on Amazon. The product is not allowed to be sold on the Amazon.com marketplace as per Amazon policy and prohibits the sale or listing of unapproved products as sale of any drug, available on prescription or over the counter, is prohibited on the website Amazon.com.

I failed to read the Amazon guidelines and applicable laws regarding Restricted Products and Medical device-related Policies and mapped the products for sale.

I have observed that I have come in a contravention of Amazons policies. I like to apologize and stress that I am determined to make sure this does not happen again. Following the complaints, I have put several procedures in place to ensure the risk of any future infringement is non-existent.

The ASIN is a restricted product, and we cannot list these products on Amazon and sell them on Amazon. As we have listed this restricted product, our account got suspended.

I was not aware that such products are prohibited for sale and did not research much because I mapped the listing which was already listed on Amazon.com.

Not ensuring that the supplier, from which I was sourcing the item, was licensed by the brand owner. And failed to submit, the requested documents by Amazon(Invoice, Authorization Letter, etc.) on time.

Fail to respond to Amazon, as Amazon asked me to submit some details about the ASIN B01176A45G on my registered mail ID dated 12-03-2024, lack of proper monitoring of my mail account, the mail was ignored by me.

I failed to read the Amazon guidelines and applicable laws regarding the resale of such products, especially the restricted product Policy and FDA guidelines and listed products, which are prohibited from sale on amazon.com

We are sellers on Amazon, and we were not aware of the restricted product policy, we were also not aware that we are not allowed to sell products that belong to an unapproved category. It is a mistake from our end that we have not read those policies and we apologize for it.

We have now gone ahead and did the following-

• We have gone ahead and checked our entire catalog to make sure that we do not sell any products that are restricted. We have checked each marketplace and made sure that all the listings that we have are not restricted and we have the approval to list these products on Amazon.

• We have gone through all the Seller University Videos and Help Pages related to “Restricted products”, “Prohibited Products”, category product and restrictions”, etc. and now we are aware of all the policies related to the listings and we will make sure that we will follow all the rules and regulations before listing any new product on Amazon. I also read all applicable laws, including the FDA guidelines regarding medical devices.

• We are going to check whether we are allowed to sell certain products before sourcing the products and before listing them.

• After reading the lists of restricted products, I went through my entire inventory together with a medical specialist and removed the items that may have been in a violation of Amazon policies, restrictions, or applicable laws.

• We have already removed any units that were there in the listing, and we will make sure that I never list any prohibited products on Amazon.

Steps I have taken to prevent this issue-

As soon as my Seller Account gets reactivated, I plan to change the product category I will sell on Amazon and decided to move to sell the items in the “Grocery, Home Appliances, ” category.

I will source/purchase items by contacting the brand owner to find the authorized/ verified suppliers of these categories or directly from the manufacturer.

I have decided to use Amazon FBA service for my entire inventory, as currently I am using MFN service.

• We apologize for listing these products and now we have read all the rules and regulations regarding the sale of restricted and prohibited products on Amazon and now we know which products we are allowed to sell and which we are not allowed to sell.

• We have checked all our catalogs marketplace-wise, and we have made sure that there are no restricted and prohibited products listed on our account.

• We have removed all the units for any prohibited and restricted listings from the managed inventory.

• Before listing any products, we are going to check if we are allowed to sell the product or not by going through various help pages and FDA guidelines and once, we find that we are allowed to sell that product then we will source and list the product. Otherwise, we will not list the product and, we will never source these products as well.

• To help me ensure that I do not violate any Amazon policies, I will also consult whether each of my products doesn’t require a prescription or medical professional supervision with a specialist, before listing them.

• I will regularly review Amazon policies again to catch any of their updates and monitor changes in FDA laws and regulations to ensure I can immediately take action and proactively remove any potentially incompliant listing on time.

• I have updated my compliance reviewing/audit process. I now have set up a recurring reminder in my daily calendar to review Amazon's guidelines on every other day basis. It will consist of a printed-out checklist of our products to match up against the Amazon-restricted products page.

• I have established an organized system to keep all the purchase invoices and bills so that I can produce them whenever required.

• I have set up a team/unit of my staff to verify every item I will purchase from the supplier. This team will check the items and verify its authenticity and originality. This team/unit will also ensure that the product sent to customers is according to the item’s details page, images, and volume mentioned in the item’s details page on Amazon.

• I will assess messages and metrics of my Amazon seller account and respond to the messages will address the issues on a timely basis and will try to resolve the issue on a priority basis

We have also gone through below mentioned policies to ensure that we are aware of Amazon's policies.

After reading the above Amazon policies I learned:

• I am responsible for complying with the law and Amazon’s policies. Customers trust that they can buy with confidence on Amazon and receive authentic products that arrive in the condition as advertised.

• If I Sell a product in violation of the law or any of Amazon’s policies, including those listed on the Restricted Products pages, Amazon will take corrective actions, as appropriate, including but not limited to immediately suspending or terminating selling privileges, destroying inventory in our fulfillment centers without reimbursement, returning inventory, terminating the business relationship, and permanent withholding of payments. The sale of illegal or unsafe products can also lead to legal action, including civil and criminal penalties.

• Before listing any branded product, spend time researching their authentic supplier store all related documents in a proper way, and submit when required.

• It is my responsibility to source, sell, and fulfill only authentic products. The sale of restricted products is strictly prohibited.

• Maintain and Provide Inventory Records. Amazon may request that I provide documentation (such as invoices) showing the authenticity of my products or my authorization to list them for sale. Providing documents that have been edited in any other way or that are misleading is a violation of this policy and will lead to enforcement against my account.

Before I list any new ASINs, I will ensure that I check the authenticity and intellectual property complaints and restricted products so that I do not list those ASINs for which I am violating any policy issue from Amazon.

I will ensure that from now onwards I will keep checking the performance notifications and I will work on that day itself when I get a notification.

Also, I have not mentioned any words that are not allowed to be used in Amazon, and this will ensure customers get 100% satisfaction.

I have observed that I have come in a contravention of Amazons policies. I like to apologize and stress that I am determined to make sure this does not happen again.

However, I would encourage you to submit strong evidence to support your case. What I can suggest is for you is to send strong evidence like documents that can prove that what your appeal says is doable.
