Amazon.com is selling my product without authorization

Amazon is selling our trademarked branded products without authorization. They are selling our products for a ridiculously low price, lower that our MAP. We have no idea how they aquired our units either and would like to prevent them from selling our stock. Please advise.

those are your returns in their warehouse, which they are attempting to resell at a lower price for clearance.

one thing to keep in mind is that Amazon does not do good job on return inspection, so don't be surprised when customers call you and said they have problem with the product and ask for refund/replacement. They'd think they bought from you but in fact it's from Amazon return dept.

Amazon. They own it. They reimbursed you for it and bought it and when they do that, its to do with as they please.

I'll be doing a test buy and report them for infringing on our trademark to see if that can get them to stop.

There is no trademark infringement happening here. They are selling on your listing, and the Brand Parameter would be correct.

Check your account settings. You might've given Amazon permission to buy and resell your product.

I had the same exact problem even though I've clearly specified in my settings to have any damaged units returned to my home address. It was only one unit they sold but Seller Support was gaslighting in their response, claiming that Amazon was not selling any unit of my ASIN, despite me having the screenshots to prove it. I still am unclear as to why that unit was never returned to me.

Yes they do have your authorization to sell/recover your FBA product

Hilarious how this forums is so so so anti reseller without authorization in triplicate unless that person is Amazon then "It's fine really".

They will "lose" your inventory, take it, sell it below your map and if you are really unlucky like I was your buybox then becomes suppressed for a long time because Amazon stole your product and gave it away. Welcome to Amazon :(

NO ONE on this forum can help you. The correct advice is to contact a trademark attorney - give them all the information and sue Amazon if necessary.

The "arbitration clause" does NOT apply to trademark infringement when its Amazon themselves violating your trademark.

And since they may be returns and Amazon is NOT the customer of first purchase the "first sale doctrine" (which Amazon does not follow when it comes to 3P sellers) will not apply to Amazon either,

But you need a trademark attorney.
