I’m beyond frustrated and need some advice here. I recently discovered that a seller on Temu is not only dropshipping my product, but they’re also stealing my product images and descriptions, listing them on Temu as if they own the brand. They’ve ripped off everything—design, images, branding—all of which I created myself.
Here’s how I figured it out: I saw my product on Temu and, to test it, placed an order using my own name, Berkay. When I got a notification in my Amazon account for an order under my own name, it was clear that this Temu seller was using my Amazon listings to fulfill their orders. But it gets even more absurd—after shipping the order, they filed a return request under my own name, claiming they didn’t receive the package. The message I got literally read: “Hello, I didn’t get the package but the order said it arrived a few days ago. Was there a misunderstanding?”
So, in summary:
-They’re using my Amazon store to fulfill orders they take on Temu.
-They impersonated me, Berkay [Moderator edit: removed personal data], to try and get a refund on an order they made under my own name.
-They’re copying my product, my images, my branding—everything—without permission.
This is identity theft, product theft, trademark infringement, and fraud, all rolled into one. I reported it to Temu, but they said they’re unable to do anything meaningful. And so far, Amazon’s response hasn’t been quick or effective either.
Has anyone dealt with anything like this before? What’s the best way to get Amazon to take action? Should I be taking immediate legal steps? Any advice from those who’ve been through this would be greatly appreciated.Thanks in advance.

This can be really bad, if he just use your Amazon store shipment to earn the difference in price may be justifiable, after all, your Amazon store also earn profits, but he actually only refund that is too bad character, more hateful is TEMU this kind of platform will not be able to accept your brand is violated!

Collect the proofs, send to Amazon, i think they will address it serious.

Unfortunately, no one is likely to do anything. These scammers are scraping listings from all over the internet, Amazon, Etsy, Ebay, websites and posting copied listings to Walmart, Bonanza, Alaibaba, Temu, phony canned websites of their own, you name it, pretty much, any place they can find to throw up a listing.
And it gets worse. Usually, multiple IDs are doing the same thing, so there might be thousands of copies of your product all over the place. They set up fake accounts in their victims' names, steal identities, and sell any personal information they can get to other scammers. Then, they make fake claims to whatever venue they purchased from and easily get refunded, so it's very lucrative and profitable scam and it's being carried out on a massive scale. with all kinds of products. It boggles the mind and is almost impossible to believe that nobody seems to care.
And it gets worse yet: If you are successful in filing an infringement complaint and get a few of their listings taken down, then they attack your business by having people make complaints, leave negative feedback and reviews, chargebacks, and make other phony claims.
Please come back and update if you find any path to get anything done. We are going to try filing Internet Crime Complaints and writing to our State Attorney General, but I am not really optimistic that anything will come of it.

I am confused. They purchase products from you on Amazon at full price and resell it on Temu where you have no presence. And are making money. So what is the problem?
The same exact same thing happened to me with Walmart. Started with one seller now there are eight other sellers copying my product listing from Amazon, changes the brand names and use the same method of scam. I reported it to both Amazon and Walmart. I did a Walmart test order; they ordered from me and shipped my product to me. I canceled the Amazon order as undeliverable address. (Amazon docked me as a canceled order.) When seller had no product to send, they shipped a 2 oz package to someone in my zip code to show delivered of course I did not receive it. Post office confirmed a 2 oz packaged tracking to a different address. My product is 4 lbs. I do not know how many of my orders that customers claimed delivered but did not receive where by this scam. Amazon and Walmart are still letting it continue.
The return scam aside, at last they are not just counterfeiting your item and you get nothing, which happens to me. I don't worry about the ones who actually drop ship off my Amazon; at least am getting paid.
File a complaint with the Internet Crime Complaint Center (IC3) it is a government entity. It is the central hub for reporting cyber-enabled crime. It is run by the FBI, the lead federal agency for investigating crime. Don't accept it as the cost of doing business. IC3 is the main intake form for a variety of complaints — everything from cyber-enabled frauds and scams to cybercrime — so file a report even if you are unsure of whether your complaint qualifies.
What you describe is the subject of a lawsuit that I and others recently filed against Walmart: you will have to google: "Walmart Organized Retail Crime Class Action Litigation". from there you can scroll down and get more info.

I have reviewed the situation and submitted a report to the appropriate team for investigation and potential action against this buyer activity. I was unable to find any case IDs from you reporting the abuse to Amazon however. If you haven't yet, please do create such a case directly with seller support and share that Case ID with me when available, so I may use it to illustrate the standard path channels have been used.
Next, for good measure, I would recommend continuing to report the violation to Temu, as the platform where the infringement on your brand is occurring. I can help share the following resources on reporting infringement within the Amazon marketplace in case there is any useful information there for what they may require.
While the team investigating my report will not share any findings or outcomes of their investigation with you or I, please know the report will be reviewed for appropriate action.
Specific to the Order ID shown in your images on this post, I do not see that the customer's claim was granted so you were not held financially responsible nor was your ODR metric impacted. Please let me know if you see anything different from your end.
