Suspended Account for IP/Patent infringement - Please Help

I am out of ideas, so I am coming to the seller forums for help. I will try to make this as short and sweet as possible…

We have been selling on amazon for 7+ years. Recently (until we were shut down) we were averaging over a million dollars per month in sales. We sell car/truck accessories and trailer parts.

We used a company called Dci, who gains authorization from the manufacturers to allow us to list their parts, use the pictures and item details and we purchase these items through a distributor, who ships them to the end customer for us.

We received IP notices for a few parts we have been selling for years and even a patent one (which we find out now that it’s a patent issue between the Manufacturer and a car company).

Our inventory in amazon was probably 90% car/truck accessories (which made up maybe 10% of our sales) and 10% trailer parts (which made up maybe 90% of our sales). Well, when amazon shut our account down, we are losing all of our sales over a few select ASINs that we never even sold. We decided the day we were shut down, that the policy violations were not worth losing all of our sales, so we deleted ALL car parts from our amazon catalog and appealed the suspension numerous times, all while failing to get reinstated. We have contacted the manufacturers, written, called, everything.

The first time, it took almost 2 weeks to even hear back from amazon. So did the 2nd time. We just keep getting the same responses - it’s like a vicious loop we are being put through. We have been shut down for almost a month now and have probably over $1.5m in sales now - all because of a handful of ASINs that we had never even sold, yet have had listed for 7+ years and WERE authorized to do so - yet through a 3rd party service, not the actual manufacturer.

We understand the policies now and have told amazon that (after calling and speaking to numerous people who have told us exactly what we need to let amazon know - that we understand the policies and know how to prevent any issues in the future) and have even deleted the items from our inventory - so I’m not sure what else we can possibly do to get turned back on.

It’s Easter weekend and we are about to have to let go of employees because we aren’t making the sales to justify keeping them employed.

And to top it all off…for the nearly a month that we have been shut down, amazon has been holding all of our money (hundreds of thousands of dollars) and won’t tell us how and when we can have it.

Does anyone in the community have ANY ideas on how I can get reinstated? We are really trying to do everything we possibly can, yet nothing seems to be working.

Amazon does not care how much $ you were making per week. You had a violation. You even admit it. Two weeks is fast, sorry, you are not special in Amazon’s eyes. You are drop shipping, Amazon isn’t a great fan of that… And now they are no longer accepting your excuses.

You failed to post your suspension email OR your appeal, so no one can help you. There is no magic handshake, no secrete email address. Post your suspension and appeal letters, or don’t… Your choice.

The email you received from Amazon should have told you the ASINs in question and what Amazon wants from you in order to be reinstated.

It does help if you post it.

The product which there is patent dispute between two other parties is not going to be resolved in your favor by Amazon. This is a risk every reseller takes when they do not own any IP.

For most other IP authenticity issues wholesale invoices from the manufacturer or their authorized distributor will suffice, unless the manufacturer has an authorized distribution chain which Amazon requires you be a part of.

BUT from your post, you are using your supplier to drop ship, AND some of these products are products you have never sold. You cannot resolve these issues. You have no invoices. It has been common for many years for sellers in categories like auto parts to list their supplier’s inventory and live out of it. Since Amazon has increased its anti-counterfeit activity, that has become a high risk business strategy.

My personal opinion is that if you write a plan which can get you reinstated, by limiting your offers to inventory you can prove authenticity for, you may have a much smaller Amazon business.

Because there is so much money involved I would hire a professional Amazon Workout pro.
There is a woman, she was interviewed by the magazine I think it was the Verge. and then I googled her and found a couple you tube videos she made. She seems like an authentic pro. The article was called Prime and Punishment

II would hire her.

You may think it’s a loop, but they are right. They need to hear from the rights owners that they are removing their complaints. You can not provide this, only the rights owners, who complained, can reach out to amazon and tell them this.

So at this point I know your mad at Amazon for the delay… it isn’t Amazon. It’s the 3 companies that complained. THEY haven’t done their end and told Amazon that you are ok to sell.
