Read onlyI recently received 11 formal intellectual property warnings in my seller metrics. These have been there for about a week and I have not heard more on it from Amazon. However I am not sure if I should appeal or if it is a ticking bomb and needs a response.
I recently listed some new lighting products from one of our suppliers. I listed them under an existing ASIN, as we are supposed to. I did not sell any of these items. I received the notice complaints from the apparent trademark owner.
I understand this seller can choose to restrict who else sells the product. I do not plan to relist this brand. I just want the violations to go away and not be something I am looking over my shoulder at.
If they have not suspended me at this point, can I breathe easy, or again is this something that is just waiting to bite me if not appealed? Again I do not want to appeal to list them.
I have noticed that Amazon now often suspends the seller after 1-4 weeks past the receipt of an infringement Policy Warning.
You should definitely respond. I would also advise you to keep your contact information up to date and carry your phone with you as you might receive a pre-suspension phone call from the Account Health Team anytime and be asked to submit a POA within 24 hours to address the complaints, otherwise you get suspended.
This happened to me 3 times since the beginning of September and many sellers whom I know had the same experience.
Did you have permission to sell them here?
Are they an exact match to include packaging? When Amazon says exact they mean exact in every detail.
I am already pretty tired of how Amazon tried to implement this process and it is already being taken advantage of. How there are 30 of the same Chinese item all with different listing pages and ASINs, all magically have only 1 person on the listing, and the brand name matches the 1 seller. So people are scrambling to make bogus brands, and list stuff as theirs, and now are all at war with who Amazon will side with when you each attack each other for being on an item you ‘branded’. What a joke.
If they own the rights and don’t want you to sell it on amazon, be kind and DROP it. I’ve had to deal with many people like you.
I just had my first experience with this a couple of weeks ago - for a book. The listing was blocked. That’s fine - I’ll just throw it away. But I don’t understand the procedure. I read Amazon’s stuff on Trademark and it ways the item will be removed. Since I don’t expect to ever have reason to deal with this book again, I’m not understanding the need to get permission. Also, I wonder if all my books are blocked somehow as there hasn’t been an order since 11/7. In ten years this is very unusual. I don’t sell a lot, just a couple a week. Very frustrating.
I had the same thing happen with 19 IP claims coming in around September. I thought I was in the clear because almost all had bogus emails attached and had not been contacted by Amazon at all since then. At the end of October I was hit with a suspension for 1 of the IP claims from Sept and my account was shut down basically. I filed a POA and was able to reinstate my account after 3 days. However my original POA was rejected because I did not make mention of the other IP claims. I would proactively make a POA and have that ready SHOULD Amazon move forward with any decision. Everyone here can give you opinions but at the end of the day it is YOUR business and as so you should take every measure to protect it. By having everything ready you can feel better knowing that you are prepared should anything happen. Like you I listed items I got from my distributor which another seller filed claims on for the trademark owner. I think it is simply a way to remove sellers from certain listings. I get it but I wish there was a way of preventing an account suspension as I had never had issues until this started. Best of luck to you in whatever decision you make.
