Read onlyHi,
We have a trademark that is currently in pending status and under examination. I have initiated the brand registry process and understand that the privileges will become active once the trademark is live on the USPTO.
My question is: once the trademark is live on the USPTO, how do I inform the brand registry, or is there an additional process I need to complete?
What you did is the easy part. Now, here is most of what will come next.
Now if your brand does not exist, any one of these can cause a problem.
- Getting approval to sell your brand.
- Getting approval to sell in the category
- Getting approved to sell the actual product
- Your product UPC must be in the GS1 data base in your brand's name.
- Don’t request a UPC exemption when you are a manufacturer and owner of your brand
- Your packaging must meet all US standards
- Does your product have proper labeling and packaging in an easy-to-read format?
- The quality of your branded product's photos may need improving.
- Do you have all COC’s that may be necessary, issued from a USA based Lab.
- Do you have the PENDING or FINAL SECESSION from USTPO attesting that your Brand is now yours.
Hello @Seller_8w80u2VmRcqHW,
My name is Dougal from the Community Manager Team and there is not an additional process that you need to do when your TM moves from "Under Examination," to "Registered," in USPTO.
The status of your TM is viewable in the "Manage intellectual properties," dashboard on the Brand Registry site. When the status updates on USPTO, the status will update on the dashboard as well (usually within a few days).
As for the benefits available to you now. You can utilize all of the Selling Benefits and most of the protection benefits with Brand Registry. The most obvious benefit that you will not have until the TM is registered is the ability to report a counterfeit under the pending TM.
Please let me know if you have any other questions.
Best, Dougal
