How to List My Own Products Without a USPTO Trademark in Brand Registry?

Hi everyone,

I own my products and have already registered my UPCs with GS1. However, I do not have a trademark registered with the USPTO yet. I want to list my products under my brand, but I’m unsure whether I need to go through Brand Approval or if there’s any way to qualify for Brand Registry without a USPTO trademark.

Can I still list my products under my brand name? Or would I need to get a trademark first to be eligible for Brand Registry? Any guidance on the best approach would be greatly appreciated!

According to the FAQ section in Manage your Brands, you can list products through Brand Name Approval while working on your trademark. You'll need to provide:

  • Your exact brand name as you want it on the listings
  • Your GS1 UPC information
  • Real photos (not computer-generated) showing your brand name permanently affixed to the product or packaging

The help page notes that "the branding must be distinguishable from similar products that do not belong to the brand" and cannot be digitally added or attempt to hide a different brand name.

For the additional features you mentioned (Brand Registry), Amazon Brand Registry explains you would need one of these:

  • An active registered trademark
  • A pending trademark filed through Amazon IP Accelerator
  • A pending trademark from accepted trademark offices

While Brand Name Approval will let you start listing right away, enrolling in Brand Registry would give you access to enhanced brand protection and additional tools like A+ Content.
