open closed listing

Hi @amazon.

Our listing was closed by a patent infringement complaint which we believe is false. we were offered the APEX evaluation but unfortunately the email went to spam so we missed the deadline.

in any case, while keeping the look, feel, and functionality of the product, we now removed the infringing part (a small covered part) so we now for sure dont infringe anymore.

We provided proof to account health, but they still refused to reopen the listing without any explanation.

Can you please help out?

While modifying the product is a proactive step, in cases of patent infringement complaints coming directly from the rights owner, we require specific documentation to reinstate the listing.

Let me clarify the process for you.

As previously mentioned, when you receive an intellectual property violation notice directly from the right’s owner, you need to appeal with documentation that demonstrates the Intellectual Property Policy was not infringed.

According to our help page "Intellectual Property Policy for Sellers," here's what you should do:

  1. Provide specific reasons why you believe a mistake was made.
  2. Provide a court order demonstrating that your product is non-infringing or that the asserted patent is invalid or unenforceable.

This documentation is crucial for the listing reinstatement, as it provides legal support for your claim of non-infringement.

To move forward:

  • Gather all relevant documentation that supports your case.
  • Prepare a detailed explanation of why you believe the patent infringement claim is incorrect.
  • If possible, obtain a court order or legal opinion from a qualified attorney specializing in patent law.
  • Submit these information via Account Health page> Received Intellectual Property Complaints.

We understand this process can be complex and time-consuming, but it's necessary to protect both sellers and right’s owners on our platform.

Thank you for utilizing the Seller Forums to address this issue. Our community and I are here to provide further clarification if needed. We hope this information helps you navigate the reinstatement process more effectively.

Best,

-Roxy
