Hello guys So i check a brand (Lattafa) and it asked to get ungated this brand, after that i it got ungated and lets me the list this brand product. After that week passed and we received the product to our warehouse , and now we want to list them it says listings not AVAILABLE LIMITATION APPLY. what going on ,
You are confusing Amazon ungating you with the brand authorization. Just because Amazon may say ok, doesn't mean the brand wants 3rd party sellers on Amazon. You will have to reach out to the brand for a LOA.
Only the brand can. authorize a seller to use there patent/copywrite/trademark/designmark intellectual property.
Use of intellectual property without authorization is theft and potentially illegally using property protected by the USPTO.
Of course if your sourcing directly from the brand a commercial invoice may be successful is proving authorization.
If your sourcing from a website or store then your otta luck because listing an item purchased at retail as new is fraud and a violation of multiple Amazon policies
Hi @Sunvalley,
Thanks for the post.
Please note that if Amazon believes that a trademark is associated with a product that you are selling that is not approved by the brand for use in connection with that product, you may be asked to provide a Letter of Authorization from the relevant brand owner to show that you have permission to use their registered trademark.
