"listing policy violation" copyright infringement - Please help

Hi all,

Yesterday I received a listing policy violation for “copyright infringement” on a listing which I did not create, the listing is for a two pack of batteries (the packs are sold as single units and I polybag them and send them into amazon as 2 packs). the manufacturer is also a Japanese company and the batteries were purchased from an authorised distributor in the UK.

I really need help with this as I am afraid my account could be suspended and it is not my fault. The main product image on the listing was changed to a phone screen cover, a completely different product and then I received the listing policy violation.

I do not have much inventory of this product left and I do not care if the listing is removed., I am more concerned about account suspension/deactivation.

If I just acknowledge the listing violation and remove the listing will my account be suspended?

What can I actively do to remove the defect?

The images were changed by another seller, why is it that I got the defect?

Maybe the violation is for the phone screen cover

I am facing same problem. I am doing FBA on existing ASIN. The asin was suddenly yanked for copyright infringement. Now my account is “At Risk”, although I have not changed anything in the listing. Trying to appeal but always getting same reply to take corrective action. How I can take corrective action when listing is completely removed? Its hurting my buy box win chances.

I have also just confirmed it on live chat. This is what she replied

Jonalyn:Is this the notification appearing your selling account " Addressing your policy violations in a timely manner will prevent unnecessary disruption to your selling account."

Me:Yes

Jonalyn:As per checking when issue is resolved on your listing has been taken down, the time frame that notification will be removed is within 180 days

Yes what you said is right according to Amazon staff. But I have seen that amazon is not giving buybox to me although I am doing FBA with lowest price. But I dont have too much inventory so I cannot prove this claim.

Can someone please advise as to whether or not this should be feasible to appeal the case?

Detailed plan of action for listing policy violation:
Dear Amazon Seller Performance Team,

My name is xxxx and I am the owner of the Amazon account xxxx.

My amazon seller account has recently received a listing policy violation for the ASIN: xxxx., because I greatly value the opportunity to sell on Amazon and being keen to resolve the issue, I sent in a short appeal letter immediately. Unfortunately, in the hurry I misunderstood the desired action that needed to be taken and did not correctly address the problem pointed out by the Seller Performance Team. My appeal was rightfully rejected, apologies.

After the rejection, I have contacted two members of the Amazon customer service team, firstly, I contacted xxxx, case ID: xxxx as well as xxxx, case ID: xxxx and I have also studied the Product Detail Page Rules which have provided knowledge as to how to avoid making errors like this in the future.
It should be noted foremost that the ASIN which received the violation, was a pre-existing listing (it was already on Amazon’s catalogue) and I have sourced the product from a recognised supplier in the UK, I attached an invoice from them in the previous appeal.

The listings main image was changed by another entity, a number of days ago, to that of a phone screen cover which is not what the product is advertised as, the listing policy violation may have therefore occurred as a result of this, which in my defence, was completely out of my control, however, as a result I have gained a more in-depth understanding of the listing policies which are paramount to the customer experience on Amazon.

Having contacted xxxx, who kindly assisted to the resolution of the issue, I have decided that the correct plan of action is to delete the product listing from my inventory. Some key points of our conversation lie in the basis that to resolve the issue, I should delete the ASIN from my inventory [and no longer sell the product]. Here is a segment of the live chat transcript wherein I have been informed that removing the ASIN should fix the issue, therefore this is my plan of action to resolve the issue (the transcript continued on next page).

10:54 AM Me : I have asked this before, but I would like to clarify. If i remove the product from my inventory (by going to the ASIN in my inventory page, selecting edit and then “delete product and listing”) will this remove the defect or remove any chance of account deactivation?

10:54 AM Rep 1 : Correct! You can delete the listing from your manage inventory page if you have no interest with selling it again. And this will not affect any of your seller metrics.
10:55 AM Rep 1 : Rest assured that everything is well documented here in our system and as your reference, here is your Case ID: xxxx.
10:55 AM Me : can you elaborate on “And this will not affect any of your seller metrics.”
10:55 AM Rep 1 : Yes. If you will delete the affected listing, it will not trigger any issues with your seller account.
10:56 AM Me : ok and will this remove the copyright violation?
10:56 AM Rep 1 : Yes.
10:56 AM Me : or at least the violation from my account health
10:56 AM Rep 1 : Correct.

After contacting xxxx I then went to delete the ASIN, via the my inventory page > clicking edit on the ASIN and selecting “delete product and listing” I also tried to “close listing” from this same drop down menu, the ASIN still remains on my inventory page (however the issue may be that there still remains 1 unit of the product in FC processing), therefore (Rep 2) has advised that I wait 24 hours for the listing to be removed.

Below is a transcript of the conversation with Rep 2, they have advised the following, after I informed them that I tried to remove the listing on my inventory page without success:

11:58 AM Me : The appeal is still open for response, if I ignore the appeal will this affect account health, how long do I have to appeal the decision before account deactivation?
11:59 AM Me : the appeal is for the listing policy violation
11:59 AM Rep 2: So send an appeal and tell them that youre trying to delete the ASINalready however it was not been removed therefoere you requested for the ASIN to be removed to the catalog team

As of this moment in time, the listing no longer exists in the amazon catalogue and I have attempted to remove the listing from my inventory (without success).

I know that creating a positive shopping experience for the customers is of paramount importance to Amazon and I want to emphasize that it is also the ultimate goal we strive for. Thus, I wish to sincerely apologise for this issue and for falling short of the high standard set by Amazon for sellers.

I promise I will not make the same mistakes in any future listing of products. Needless to say, I recognise that it is absolutely a privilege and not a right to sell on Amazon. I pledge that I will take all the steps necessary to regain your trust. I hope the steps that I took in correcting this issue shows my willingness to become a better seller on Amazon. I ask that you would kindly consider removing the defect. Please let me know if you require any additional information and I will be more than happy to provide them.

Hello @AnytimeTrading,

From your post I understand that you have received a listing policy violation on a listing and you need recommendation to remove them.

Listing policy violation is something where the attribute of the listing has been tampared by a seller. As you stated you are not the creator of the listing but you are geeting the products from the authorized distributors, try to update the violation with the correct details by reaching out to the seller support team.

If you think you are at fault then removing the listing will be the correct decision and with that you have to share an action plan why did you list the product in the first place?

To remove the violation you have to check your performance notification which you have received as a warning all the details will be mentioned there, which attribute has been tampared and how you can fix it.

If you have the correct image then update the listing with the proof and get the asin activated.

I would request you to check the notification which you have received in your performance notification to get a clear understanding of how to fix the violation.

Regards,
Dhoni

I have just submitted another appeal today using the content above, which has been rejected. Upon further investigation into the issue in my performance notifications page, I can see that the issue is:

Detail Pages Needing Correction

ASIN: XXXX
Attribute Needing Correction: Images

However, as the listing is no longer in Amazons catalogue, I cannot access it to change the images, what should I do now?

I sent the appeal stating that to remove the defect my plan of action was to remove the listings,

I accidently only deleted the FBA listing from the Manage My FBA inventory page and did not completely remove all listings of this ASIN from my account (there were still merchant fulfilled ads for the ASIN within the “manage my inventory” page).

I have also got in touch with another rep who has stated that deleting the listing won’t remove the defect, how can one rep clearly state one thing and then another state the complete opposite?!

I have tried changing the main image on the FBM ad to the original image, however this hasn’t changed yet (I tried to change it about 3 hours ago) it does not appear to be changing, it just states “no image available” on the thumbnail of the ad in the my inventory page.

Should I ignore the third rep and delete the listing and then re-submit the plan of action which is that I have fully deleted the listing from my inventory (in which case this time I actually will delete all the ads), or should I try and change the image which was the main reason why the ad got flagged in the first place. I cannot add the ASIN back into my store via the “add a product” page as it is no longer in amazons catalogue, so if I delete the ad I will no longer be able to edit it as the ad cannot be added back to my inventory).

Please help urgently.

Thanks

I had one of these recently where by a top selling product we have , which is a 2020 desk diary where we have sold over 600 units FBA suddenly the images changed to that of a Lap top stand with Apple computer.

Reported this to amazon , Amazon told me i could not change the images back to the diary as I was not the brand owner and then i immediately got a listing violation and told to create a plan of action .

The listing got removed and I had 200 plus units in stranded inventory .

Several appeals later the listing got re-instated , but the wrong images still appear on product detail page.

Raised te issue again with seller support and got firmly told to wait 48 hours for the images to updat.
Still no update as they can not update the images as I am not the brand owner

I am facing same problem. My one listing was removed for copyright infringement. This is our top selling product, we we have more than 200 units in FBA. I did not receive any emails saying that listing was infringing. The seller service told us my listing was infringing but they don’t know where the infringement is. Trying to appeal but always getting same reply to take corrective action. How I can know where my listing is infringing. How I can take corrective action to relist my listing? Please help. Thanks.
