Thanks for posting to the Forums. I've reviewed the details of this issue. I have a found a related thread where there may be a solution that could work for you. As per the advice from @Seller_77IcbQKVGdZo0:
"I came across this recently. It probably means Amazon have removed permissions for you to list new ASIN’s for that brand. If you try to add existing skus to a new parent you will get error 8040, if you try to list a standalone sku then you will get error 5461
You will need to get Amazon to authorise you to list new ASIN’s the brand. Try creating a standalone listing for this brand and see if you get error 5461, if you do you will get a link to get catalogue authorisation for that brand. Then just follow the instructions. For me it took around 48 hours to get permissions back."
Give this a shot and let me know if you still run into this issue.
