I can't list my product

My Brand Name Is Not Getting Approved , My Brand Is An Eyewear Brand , Our Brand Name Is Similar To an another Brand but both are in different segments also there is a court case going on in which the other company has got rejected to use my brand name in the eyewear category.

I am getting error 5461, whenever I try to list my product, and whenever i try to apply for GTIN EXEMPTION , they tell me to list my product as generic
