Copyright Image Misuse

Hello,

I have several "Copyright Image Misuse" under "Suspected Intellectual Property Violations". We took the images. We have submitted for copyrights on the images. No one is saying that the images belong to them--this is NOT a "Received Intellectual Property Complaints". I have submitted for a copyright on my image, but it has not been approved by United States Copyright Office (yet). The item is listed under our brand. I first submitted a Letter of Authorization from me (personally) to my corporation. I have submitted a second LOA from me (the copyright owner) to the brand, but I suspect that this will not work either.

The bot is saying that the image is copyrighted by a famous national brand. That is impossible. I have the original unedited photo taken by me! SS is unhelpful. They say to submit a new LOA through account health, but when I click the link on account health, it just takes me back to SS chat (which is unhelpful). I'm in an IP loop!

Not enough information, so just a thought...

That you took THIS picture yourself, doesn't automatically mean it can't have copyrighted content.

For example, I can draw a "swoosh" on a cup and take a picture of it and Nike will have it shut down because it looks like their symbol....

If the USPTO grants your copyright application then you can file a DMCA appeal for current complaints as well as a lawsuit against those making complaints at Amazon (only for complaints filed AFTER the date of your valid copyright being issued).

Speak to an attorney as NO ONE on this forum or at Amazon can help you.

I understand that the copyright violations can be concerning if you created the images that are being pulled down. I do want to provide additional guidance and support, but do want to clarify a few things.

Outside of the ongoing registration with the copyright office, do you have any other details or information that can show the photo originated from you? In addition, would you be able to clarify exactly what the brand it is that our team has concerns with and the type of product you are selling? Have you attempted to open any cases into this concern as of yet?

We encourage you to continue to refer to this thread with information on the listing and details on the actions taken so that we may gain a better understand and provide support.
