Account at risk of deactivation for listing Dogma movie?!?!?

I just received this message from Amazon:

Hello,

We removed the listings at the bottom of this message because we received a report from a rights owner alleging that the product or product packaging on the listing may infringe the rights owner's copyright. The communication from the rights owner about the alleged infringement and the listings that we removed are at the bottom of this message.

Why did this happen?

We received a report from a rights owner alleging that one or more of your listings may be infringing the intellectual property rights of others. Listing content infringing on the intellectual property of others is against our "Program Policies":

We're here to help

For help understanding how your listings may infringe the intellectual property rights of others, go to "Intellectual Property Policy for Sellers":

https://sellercentral.amazon.com/gp/help/external/201361070

Have your listings been removed in error?

If you believe that the product and product packaging of the following ASIN do not infringe on the copyright of others, you may submit a dispute by filing a counter-notice under the Digital Millennium Copyright Act (DMCA).

Deleting the ASIN or providing a preventive document with an action plan, or any other documents that do not meet the requirements, will not be considered for reinstatement.

Alternatively, if you think that the rights owner has made an error in sending the notice, contact the rights owner and ask them to submit a retraction of this notice. We may only accept retractions that the rights owner submits to us directly. We do not accept forwarded or attached retractions.

How do I submit this information?

Go to the "Product Policy Compliance" section in the Account Health and click "Received Intellectual Property Complaints":

https://sellercentral.amazon.com/performance/account/health/policy-warnings?ref=ah_em _mpa

Locate the deactivation record for this product listing. Click the "Appeal" button next to the listing deactivation record. Dispute the violation by submitting a DMCA counter-notice from the "Explanation" link located under the appeal form.

For more information about submitting a counter-notice according to the DMCA, go to "Procedure for submitting a counter-notice pursuant to the DMCA":

https://sellercentral.amazon.com/gp/help/G202017130

What happens if I do not provide the requested information?

If we do not receive the required information, the listing will remain deactivated. The violation record will remain on your Account Health page for up to 180 days after the listing was deactivated or until the violation is successfully disputed. Deleting your listing on this ASIN does not sufficiently address the reason for the violation and will not result in its removal from your Account Health page.

These are the rights owner's contact details:

Rights owner communication: Amazon - we are writing because we have confirmed the identified listing is using our client's copyrighted materials unlawfully in the title and product images. You can find our letter of authorization attached here:

Copyrighted content:

ASIN: B000065HYT

Complaint ID: 10950759742

Infringement type: Copyright on the product or product detail page

You can view your account performance:

Alternatively, select Account Health on the home screen of the Amazon Seller app on your iOS or Android device. The Account Health page shows how well your account is performing against the performance metrics and policies required to sell on Amazon.

The thing is, I only listed this item under the standard Amazon listing for the "Dogma" movie, I did create the original listing or provide any photos for the listing. Could a mod step in and provide some advice on this? Given this situation any film studio could shut down hundreds of movie listings on Amazon without recourse.

Even when selling under an existing listing, sellers must have the legal right to sell the product. Rights owners can file complaints against any seller they believe is selling their intellectual property without authorization, regardless of whether the seller created the listing or uploaded the images.

To resolve this situation, you will need to provide one of the following:

  • Valid supplier invoices showing a legitimate supply chain.
  • Amazon order IDs proving authentic product sourcing.
  • A direct authorization letter from the rights owner.
  • A court order confirming non-infringement.

Important to note:

  • Deleting the listing will not remove the violation from your Account Health.
  • The violation will remain visible for 180 days unless successfully disputed.
  • A DMCA counter-notice is an option if you can legally verify your right to sell.
  • The rights owner (Ivan Esmeral) must submit any retractions directly to Amazon.

The seller community and I are here to help if you need additional clarification. For more detailed information, please review our help page: Intellectual Property Policy for Sellers.

Best,

-Roxy
