Read onlyHello, I am an authorized seller of a brand registered with the USPTO in the USA. As an authorized seller of the brand, I created a trademark application for the brand from my own Amazon account, but it was rejected, the reason for the rejection was that there was an Amazon account belonging to an American company affiliated with the brand owner, and this account was inactive. Amazon does not clearly state why the brand registration was rejected, but I think this is the reason why it was rejected when applying for a brand registration. I will contact the original owner of the brand and purchase all rights to the brand from the USPTO through a lawyer firm recommended by Amazon, and I will become the new owner of the brand and transfer the business address where the brand is registered to my American company, and the other account (the old brand owner whose account was suspended) will have no connection. I will be the new owner of the brand, and my Amazon account is active, there is no problem with the health of my account, and my company information, tax information, everything is registered in my system. If I transfer the ownership of the brand to my American company and re-register the brand from my own account (as the original owner of the brand), will it be accepted without any problems? Or if I explain this situation in the private trademark registration case filed against me and then transfer the brand to my own American company and then explain it to the support team, will my trademark registration be accepted? Thank you in advance for your answers.
Hello @Seller_GKlbQlz5rUgDP,
My name is Dougal from the Community Manager Team and I can provide some resources here. First, There is no way to answer if your Brand Registry enrollment will be accepted as there are several factors within the enrollment process itself.
Factors such as the current status of the brand, the changes (you as the current TM Owner) are live on the trademark office website and various factors of your Selling Account.
Since everything currently is hypotheticals, please review the Amazon Brand Registry Application Guide to make sure you will have everything you need.
If you have any other questions or would like me to take a look at an enrollment case specifically, I would be happy to. I just need the case ID to review.
Best, Dougal
This has been my experience dealing with having a brand trying to get accepted. If your able to down the road close your request and start again but only if you have everything crystal clear with your amazon account and what the USPTO has on file every bit of detail along with what your business has detail wise with the Sectary of States Office. Everything has to match to a T the spacing the uppercase lower case. If you plan on selling with your amazon business account be sure your registered information is identical with what the USPTO has on file. Meaning exact location USPTO matching the information that Amazon has on your business. The same is the case if you choose to use your personal amazon account it must m match the USPTO information on file with them. If you use most people use their business information and the owner of the trademark is the business be sure you use your tax ID number that matches. I would only use the tax ID number for your registered business my mistake was having my EIN number which was accepted amazon to verify the business but brand registry did not like it for verify business information address and tax registration number. It can't hurt to ask on the forums and see what input the Amazon seller community helpers will say. I am still trying to understand why it is so cryptic by the registry team. If you finally get registered please post and let us others know what you did. Another piece of address again everything must match even S. must be St. not street and st. It is frustrating but lets hope worth it in the end. For me the A+ content writing is really important especially being able to provide videos for potential customers. Best of luck to your business!
