Recently, several unauthorized Chinese sellers started selling my brand product under same ASIN but with much cheaper rate. I have never given permission to this seller to be able to sell any of my Product, ASINs, or Brand. This implies that they are selling counterfeit products at much cheaper rates.
The Report a Violation Tool (https://brandregistry.amazon.com/brand/report-a-violation), Account Health Dashboard Report Abuse Tool (https://sellercentral.amazon.com/abuse-submission/index.html), and Infringement Tool (https://www.amazon.com/report/infringement) are all NOT useful for this situation since the unauthorized sellers are selling a product under my product listing, using the SAME ASIN, as a second offer or multiple offers. It is impossible for me to compete with them by lowering prices. I am very worried that their tactics gonna cost me and my brand as they are producing counterfeit products.
Hence, I need a solution urgently, but so far Amazon Help is unable to offer any support.
WHITELISTING
It seems clear that Amazon is only allowing MAJOR brands to 'whitelist' which sellers are authorized.
It was suggested by one of the long term experienced sellers on a different forum that the following has worked successfully in the past.
Have your attorney send a carefully worded Demand Letter (by Certified Mail) to Amazon’s "Office of the General Counsel".
These are the most recent addresses I could find for the legal beagles…………...
Amazon.com Legal Department
410 Terry Avenue North
Seattle, WA 98109-5210
Amazon.com Legal Department
P.O. Box 81226

I would think that you would want to include appropriate paperwork showing ownership of the TM from the USPTO, proof of registration in Brand Registry, and, any links to cases and messages that show that SO FAR Amazon has refused to protect your brand.
Basically, you need to put Amazon on notice that you expect the protections promised by Brand Registry.
You need to do a test buy NOW from every single one of those sellers.
If it's a real counterfeit, Amazon will treat it seriously through brand registry. But you need to verify they are indeed counterfeits.
If it's not a counterfeit, you need to check your own supply chain to determine what's going on. Someone flipping clearance from another source? Distressed or expired inventory? Your own supplier undercutting you?
Also, look into Amazon Transparency stickers as a way to restrict counterfeits and unauthorized production.
Hello @Seller_S2JUW8loKal2m!
My name is JiAlex from the Community Manager team here on forums. I wanted to follow up on your post. In regard to this matter, our goal is always to ensure that customers shop our store with confidence. However, we consider a brand's enforcement of distribution policies and rules to be a matter between the sellers and the brand.
If you think there is abuse, you do have some options for reporting potential abuse, here are some additional details:
• Report Abuse in the Amazon Store (overview video) - Provides overview of each reporting option in the Report Abuse menu in Seller Central.
• Go directly to the Report abuse page or login to Seller Central, go to Performance, then Account Health, then click Report Abuse.
• If you have a registered brand, you may also report a violation directly to the Brand Registry team.
Regards,
JiAlex
