Hijacker Issue

We have had a recent issue with a Chinese hijacker creating an offer on our top selling ASIN. They are using our exact same images and branding and everything and winning the buy box due to dropping the price by $10. There is no way that they are selling our actual product at the price they have it at and are either selling a counterfeit, or not shipping at all. We have brand registry on our brand and are the owners, manufacturers and only authorized sellers of our products. We tried reporting the trademark infringement to Brand Registry and they require a test buy, where we purchase the hijacker product, which we did. The problem is that the Chinese seller is not actually shipping the product, and so brand registry just rejects our case since we don't have photos of the test buy order to prove that it is inauthentic. This is really hurting our brand as they keep adding more units on a daily basis, which sell out fast. Customers are starting to email us either confused about which to buy from and some who did not receive their product they ordered. We anticipate that we are going to get bad reviews regarding this as well soon. For our test buy, the tracking number that the seller put in is not a valid China Post Tracking number but rather a fake one so that they could mark it as shipped in Amazon. This is creating a terrible experience for customers on Amazon as they are being scammed into thinking they are getting the product for a better deal only to be scammed by this hijacker. It is really damaging our brand reputation.

Anyone have any advice on this? We have already sent a cease and desist and reported via the below forms, but both get rejected by Amazon due to the test buy issue and us not being able to get the product from the hijacker since they are not shipping it.

You would think that with Brand Registry that you would be able to kick any seller off your listing that is not authorized, but apparently that is not how things work. If anyone could help that would be great.

You are me 15 months ago. I am afraid that your long dark nightmare has probably just begun. When you say you have a brand trademark, do you have the full registered Trademark accepted status on the USPTO website (registration number issued), or are you still waiting for that with only an application serial number available so far. With just that you can open your Amazon store, get told you have protection against counterfeiters, etc. The reality is that, without the fully reg # from USPTO in EVERY marketplace in which you are selling, you are not protected and cannot claim infringement. The only thing you can do is buy product from the abusers, then report them as shipping product that is different from the ASIN. Pathetic, I know. In the time it takes you to do this, the crooks have already introduced another seller name doing the same thing, and then another and another and you cannot ever ever win this expensive and time consuming game. I worked with every possible group in Amazon to stop this. Bought well over 125 test buys (My product costs $11.99 in USA and $15.99 in Canada) at a little less than my resale. Spent many hundreds of hours on support calls, going in circles, getting nowhere. I eventually was able to directly correspond with Brand Outreach, which is a special privilege, once they think you have absorbed more abuse than a human should be subjected to. They were very effective for about 2 months in helping me get rid of abusive sellers, however, even they eventually tired of trying to keep up. I eventually got my TM registration # on 7/2/24 and, over the next few weeks things started to get better. Still have the problem in Canada and elsewhere as my TK only covered USA, even though I only stock product in the USA. Others try to sell it in other markets and I am not protected, About to spend another few thousand bucks to extend protection to Canada and 2 other countries. Sorry for all the harsh reality here, but it is stuff I wish I would have known a year ago. Wish we could talk but I am not allowed to give you my contact info here.

Register Transparency

Transparency helps prevent the sale and shipment of inaccurate and counterfeit products on Amazon. Products cannot even be listed on Amazon without valid Transparency codes. This ensures that customers only receive authentic units, whether fulfilled by Amazon or shipped directly by selling partners. Customers can scan these codes to confirm that the items they receive are authentic.

Of course, after registration, each product must be additionally labeled, otherwise it cannot be entered into FBA storage.

I do not see the seller on the listing anymore. Does the seller you mention disappear and appear again?

I am investigating the seller on your ASIN and it seems like Amazon has taken appropriate action on this seller. I cannot mention details since this is regarding another seller, but I can mention actions were made.

Please let me know if you continue to see the seller on your ASIN.

We encountered a similar issue with our fig cookie listing on Amazon (ASIN B07YGS4G53). Recently, unauthorized changes were made to our product description, incorrectly stating that our cookies are nut-free, which poses a significant risk to consumers with nut allergies. Additionally, another party has exploited our listing by using our product images to advertise their own similar product at a lower price.

We are the original manufacturers of this product and have been selling it on Amazon since 2017, before enrolling our brand with Amazon. At that time, the bakery section of our company operated under the name Cannoli Plus, which is how the ASIN was initially listed. Our brand is now Frank and Sal Italian Market.

Our efforts to resolve this situation have been complicated by our initial uncertainty regarding the brand name, making it difficult to prove ownership to Amazon. Given the circumstances, you’d think Amazon would at least allow us to remove or replace one bullet point: "Nut-Free: These cookies are nut-free for those with allergies."

In reality, our cookies are loaded with nuts.

We include a large sticker on the box stating "CONTAINS NUTS," but I have also had to edit the main photo, which now looks unappealing. While our regular customers know and continue to order our cookies, I am concerned that this confusion is deterring new customers.

As Always we continue to move forward on Amazon ... my sincere wish is that I would be allowed to remove one bullet point.
