Reqistering an already listed and active product under GENERIC .
I have enlisted my first product under GENERIC status (With ASIN & GTN/UPC) . Now , I intend to move for getting TM & brand registry. Would anyone please precisely guide me can I apply for TM under ACTUAL USE ?. Moreover, if I have to apply under INTENT TO USE & get approval, will the same product be automatically changed from GENERIC to BRAND (As per proposed brand name ) ?. Or will it be better to delete this listing as I'm having no sales so far & re-enlist as BRAND , followed by the TM & brand registry process under ACTUAL USE ?.
Looking forward to your expert guidance.

A GENERIC listing means a product WITHOUT brand. Therefore you don't use a UPC to create a generic listing.
If you want to sell a product WITH brand you will need the UPC. But know that THIS generic listing can NOT be transformed in a listing with brand.
So following is the best solution:
You do exactly this since (how I suppose) you have no inventory in an Amazon warehouse. You have to take a NEW UPC, not the one you used for your generic listing.
PS. If you want to trademark the same name like you forum name, do a research before, I think that brand exists already unless that's your's, of course.

Hi @Seller_TrCkLjzFd5OkF,
According to Amazon's Generic Product Policy (link), under the section "Can I change the brand string on my product from 'generic' to branded?":
"Brand string changes from 'generic' to branded, or branded to 'generic' are not allowed to protect the integrity of the product. If you choose to re-brand a product, you must create a new product rather than updating an existing product."

Hi @Seller_TrCkLjzFd5OkF
As other sellers have mentioned here, please refer for the Product detail page rules for more information.
If you choose to re-brand a product you must create a new ASIN rather than update an existing ASIN. This is true even if the product is unbranded and does not change materially after the brand change. This includes adding a brand to a previously unbranded product.
Best,
Sandy

It has greater details that we must follow during product listings. If you follow this guideline to the T, you will be fine.
