Amazon Illegally Accuses Me of IP Violation & Refuses to Listen to Reason

In 2008, I bought a DVD of Spider-Man comics from Amazon. In 2014, I sold this item on Amazon. I marked the listing for deletion after sale, as I only had that single copy.

About a month ago, over a decade later, Amazon accused me of violating intellectual property with the listing for Spider-Man DVD. Without me knowledge & against my consent, Amazon somehow maintained the listing for the product that sold back in 2014.

I've gone back & forth with Amazon reps for weeks. Amazon policies apparently prevent them from understanding the issue or being reasonable. Amazon has not provided even a shred of evidence that I violated IP in any way, shape, or form. None of it makes any sense. Reps keep repeating irrelevant policies. I don't want to relist the item. I only had one copy & I sold it over 10 years ago.

To add to the inconsistency, Amazon has not charged me with IP violation for the many other items I sold back in the day. I sold a DVD of X-Men comics in the very same transaction as the DVD of Spider-Man comics. I would greatly appreciate even a touch of coherence.

I'm prepared to pursue this matter to the utmost extent of the law & have made the necessary preparations in that regard.

Amazon seems to be going after anything Marvel related, my guess is at the request of Marvel. But why they would go after something that sold 10 years ago is ridiculous. Do you have proof of the date listed, date sold and date deleted?

As far as I have seen, unless you delete your listing using a flat file, it remains on Amazon forever. I have had listings I have closed and deleted get messages 5 years after I've deleted.

When you go to list a new item and you type the product, your old listing could pop up and if the new seller uses it and gets a violation, you will also get the violation.

I know it is BS but that is what is probably happening.

typical Amazon. Depending on your state/country, you may have a Defamation per se claim IF they accused you of a crime. Likely they worded their communication to you in some ambiguous way to avoid outright accusing you of stealing.

If the violation is not resulting in the restriction or suspension of your account, you may want to let it go or just keep emailing the team and explaining the facts.

On the other hand, if one of these unconscionable allegations results in restriction or suspension of your account, you should first escalate the matter through the Better Business Bureau and by emailing jeff@amazon.com . If you don't get things resolved after those teams contact you, consider arbitration or even civil adjudication for a libel/defamation tort claim.
