Authorized Seller Question

I run an Amazon Store with many brands under brand registry. The company I work for also sells these brands on the Wholesale and Distribution level for others to sell in their stores. When it comes to selling on Amazon we are the only Authorized sellers and do not give anyone else any type of Authorization letters or agreements.

I have been seeing a lot in the discussions of people talking about how Amazon will remove anyone on a listing that is not an "Authorized Seller". I have yet to figure out how to do that or find out if that is even a real thing. The other sellers selling on our listings are not selling counterfeit items they are legit but they are driving down the price so much that we (the brand owners and manufacturers) can barely make any money. I have come to understand these are brand new or very low-level sellers who probably don't realize they are hemorrhaging money by doing this. The issue is they keep the price so low that when they finally do run out of money and fall off the listing we put the price back to what it should be Customers get very angry until the next low-level seller comes in and the cycle starts over. My company sadly does not set MAP so enforcing that is out. I am just not sure what to do here.

We have cut off sales to some of the customers I found that buy directly from us but they end up just going to a different wholesaler to buy our products. It is really damaging our brand.

We sell the majority of our products in the Cigarettes- papers- and tubes category (risky I know but it is what my company sells).

If anyone has any advice please let me know.

I have seen people (BRAND OWNERS) saying in this forum that they wrote a simple message to Amazon (via "Help"? I don't know) confirming that they never gave authorization to others to sell their brand YYY on Amazon and asked to take the other sellers down. BUT - it seems that YOU are not the brand owner.

The company authorized you to sell on Amazon and THIS COMPANY (not you as an Amazon seIler) is the brand owner? It's a bit difficult to understand if actually you are really the brand owner or just an authorized seller. And how could you register this brand in brand registry without being the brand owner according to the USPTO?

In order to take the other sellers down you need something written from the brand owner explaining that you own the exclusive selling rights for Amazon for brand YYY and that he asks Amazon to take the other sellers down.

But double check anything. the brand owner is that one registered in the USPTO. If is this you - according to your "Legal Entity" in your seller account settings - good for you. And equally the UPC codes from GS1 have to be attributed to this exact same name.

There were sellers trying to ban other sellers who found themselves banned afterwards or even the whole listing closed for everybody.

How did you acquire your Brand. Do you have a TM. You sound like you are claiming a brand you do not own. Your company name is your Brand. Your products for sale are someone else's Brand unless you are the manufacturer. You very well could be in violation of Brand ownership. Just saying be careful with what you claim as your brand.

Who says you need to be authorized to sell products on Amazon. Counterfeit without a test buy you are breaking the law accusing someone of selling counterfeit without knowing 100%. Report the wrong seller with deep pockets and end up getting sued for damages.

When you sell to these small guys, you did not say they cannot sell on Amazon. Where there is no law, there is no sin. By the way, where do you expect the little guys to sell these items. Amazon and Ebay provide the level playing ground.

If you are the brand owner and manufacturer, how can they drive price below your price. The is cloudy.

Despite what random forum people (yes even ones with lots of posts) claim Amazon very explicitly will NOT control "authorized sellers". If you want to control that control your distribution channels better, that isn't Amazon's problem. A lot of sellers on this forum like to play games like "counterfeit without test buy" which is eventually going to land them in court when they hit the wrong reseller.
