can i sell this product?
Hi im a new seller i had one question in my mind
i saw a private label product which had really good profit margins.So i seached for the brand but coudnt find any website where i could get approval to sell this product. the owner himself source it from china(its on the product) and it didnt had any packaging or anything so i did some research and found a very good manufucturer in china selling same product. I purchased 10 units from them and when i got it then i applied for ungating abviously it took time(15 days) got get ungated now im sending it to amazon but i was thinking if he had trademark so will he try to hurt my account? the product is same as his but still i was thinking if he is gonna do anything? and can he? i will keep the price same as him because i am not trying to highjack his sales...any comments on can something bad happen? i know i thinked about it at the last but i didnt knew about many things before..I THOUGHT IF I GET UNGATED ILL BE ALL OKAY..

Yes, probably. You listed your generic unbranded item under a branded listing. You are counterfeiting.

It's not the same because their product is branded, and yes they can either do a counterfeit without a test buy, or do a test buy and report as counterfeit. At which point, your account will get suspended if you can not provide the proof you have authorization from the brand owner to resell and buying from an authorized distributor of the brand owner.

Using another brand’s Intellectual Property in your generic product listing, or listing a branded product as generic, are violations of our listing policies. For more information, see our Brand Name policy.
In general I would not recommend listing your branded products under a Generic ASIN. This is a violation of the Generic Product policy.
Eventually, you may also develop your brand and get a registered trademark which will allow you to register your brand in the Brand Registry program.
