My product is patent pending. But I have a trademark on the product name and have been accepted for brand registry. A non-US based company went to great lengths to injection mold the parts and assemble them using similar parts (11 total parts). Their product is nearly identical in function and appearance. They even state that their product is "comparable to (my product)". They even use my product in their photos on Amazon, which is odd considering their knock-off looks almost identical.
I have read that Amazon won't take them down unless I have been granted a patent (mine is pending). However, they can not use my product in their photos, right? Can someone point to a specific Amazon Seller's Guideline that this violates? Or have any other specific suggestion ?
Hi @Seller_gdj0YcplHyA8j
My name is Sandy from the Community Manager team.
I need to look at your brand registry trademark status, product details and the other ASIN to provide the best guidance.
I was not able to connect to any brands registered in brand registry from this forums account. Was this question for another account? If yes please let me know the case ID in which you reported the ASIN.
Best.
Sandy
