You want to sell Banana’s on Amazon.
You find a similar Banana on Amazon and decide to list it under that ASIN.
You get suspended because that Banana is sold under the brand Joe’s Banana’s.
You are not Joe and you are not affiliated with Joe in anyway. You are Tom and imported the Banana’s yourself. You should have created your own brand “Tom’s Banana’s”. You then should have made a new Amazon detail page for that Banana with the Brand being Tom’s Banana’s.
Next you decide you still want to sell under Joe’s Banana’s. You go to S-mart and buy a bunch of Joe’s Banana’s to take home and ship to your customers.
Joe, having never consented to you reselling his Banana’s, files in inaunthetic item claim against you.
Amazon asks you for invoices from a Joe’s Banana’s authorized distributer. You provide your receipt from S-mart, which is a retail receipt and not a commercial invoice.
Amazon rejects your receipt and suspends your account.
This time you decide that this time you are going to do this correctly. You go and find an authorized distributer of Joe’s Banana’s and purchase directly from them.
Somebody at Joe’s Banana’s corporate decides they want to be the sole supplier of their Banana’s on Amazon and starts filing infringement claims again anybody selling Joe’s Banana’s on Amazon.
Amazon asks you for invoices for the banana’s you bought and a letter of Authorization from the company allowing you to sell Joe’s Banana’s on Amazon. Not having the LOA, Amazon suspends you.
Bravo!
I gave a similar explanation not long ago (with Bananas for scale!): Permission to open a brand
"Amazon is a marketplace. So visualize it as a farmers market.
You want to sell bananas. So Amazon told you that you can stand in the corner where they are selling bananas.
Now, Amazon didn’t say what bananas you could sell. It didn’t say if they were Chiquitas or Dole. It just said that you could sell bananas.
So you go to the corner and set the stand to sell the bananas. But somebody else is already selling Chiquita, and that seller has a letter of authorization, straight from Mr. Chiquita, selling that they are the only ones who can sell Chiquita. In other words, you’re not authorized to sell Chiquita. Same thing happens at the Dole stand.
There are multiple things that can happen. If you spoke with Mrs. Dole or Mr Chiquita, and they wrote you a letter saying that you can sell their products, then the current sellers (begrudgingly) will have to give you a space on their stand (fight for the buybox). If you don’t have the express authorization by either Dole or Chiquita, not only will they not share their stands, they will tell Amazon (the marketplace) to kick you out. Amazon will do it, and will put a picture of your face in the entrance saying “banned for ever”
If you have another brand of Bananas, and you’re authorized to sell those, or if they are unbranded bananas, then you can sell them without interfering with Mr. Chiquita or Mrs. Dole."
Bravo!

No, no bananas.
Sorry, lightening in LA has caused a weather delay for a covered dome. And Facebook was down for like 4-6 hours today. I am surprised there are not riots, or at least protests.
I lost count of the misplaced apostrophes.
TallyTony and Default_User_Name - THANK YOU for the excellent example, implied advice, and sense of humor! We need more people like you around. Thank you for being good people and kind players in the time of a bunch of gremlins!
Yes, we have no bananas:rofl:
I guess it is better to sell bananas than go bananas. Or maybe trying to sell bananas on Amazon will make you go bananas.
Or maybe you can create a fruit ripening bundle - a banana and a brown paper bag and offer it for use to ripen other fruits.
I always look for deeper meanings in the posts.
What if we got Johnny Chimpo involved? I think that would cloud the situation a little.
At what point do I post on the forum about how Amazon is being unreasonable to banana sellers and ask if anyone wants to join me in a class action lawsuit?
i do have a question along these lines. for some brands amazon requires you to supply EITHER an invoice OR letter of authorization. after supplying amazon an invoice from a reputable distributor, you are approved to begin selling the brand on amazon. 8 months later brand owner only want 5 distinct sellers to offer their products on amazon and no more so they report you to amazon as unauthorized. for fear of losing your selling privileges you liquidate all of your $10k worth of product and delete the listing from your inventory.
what are the ethics in this practice? how is parity of competition in the marketplace supported in this way when not even the us federal government supports this nor any court system in america.
