Sharpie Markers now considered hazardous

I just wanted to let everybody know that Amazon now considers normal sharpie brand markers hazardous materials and considers them to be extremely flammable. According to their support personnel I need to take extreme caution in handling them.
In case you have an already realized the above information that Amazon provided me is incorrect.
Certain paint-based markers may be considered hazardous but the majority of sharpie markers are not considered hazardous. There are many many different sharpie products in multiple colors, shapes and sizes. This is been an intermittent problem for years now, Amazon confuses paint markers with standard markers. The most recent casualty of this is B01KU4IUAM sharpie retractable black fine point markers and a box of 36.

I don’t believe you realize just how dangerous a Sharpie can be.
Look at the name. It’s obviously a weapon.
Some people sniff them to get high. Remember, drugs are bad, mkay?
They’re so bad that for years it was illegal to sell one to a minor in Texas. I understand it’s still illegal in some states.
If I’m not mistaken, the last time I bought one at Wal-Mart, they had to verify that I was an adult.

I don’t know who said Newell had not or will not prepare MSDS for Sharpie Markers but that is incorrect. ALL such products sold to individual and commercial consumers MUST have an MSDS for many reasons, not the least of which is the fact that children and persons with mental challenges can and do use these markers and may ingest them. Parents, caretakers, emergency personel and or anyone else who may have an allergy to any components need to have access to an MSDS. Finding the MSDS wasn’t that hard. When I get a chance tonight I’m going to compare the meta-data in the SDS PDF on the dick blicks art supply website against SDS PDFs posted on the manufacturers website. I suspect that the one that is posted at Dick Blick is a forgery that someone created the document to satisfy those looking for a SDS that does not exist.
Newell-Rubbermaid (NWL) writing instruments comply with U.S. OSHA GHS Hazard Communication Standard of
29 CFR section 1910.1200 (OSHA HazCom 2012) by virtue of exemption as 'article ’ and as ‘consumer products’ per 29 CFR section 1910.1200(b)(6)(v) and (ix). Therefore, GHS Safety Data Sheets are not required for our writing instruments.An ‘article’ is defined in Section 1910.1200© “as a manufactured item other than a fluid or particle:
• Which is formed to a specific shape or design during manufacture;
• Which has end use function(s) dependent in whole or in part on its shape or design during end use; and
• Which, under normal conditions of use, does not release other than very small (minute or trace) amounts of a
hazardous chemical and does not pose a physical hazard or health risk to employees.”
The ‘consumer product’ exemption in 29 C.F.R. section 1910.1200(b)(6)(ix) states that:
• Any consumer product or hazardous substance, as those terms are defined in the Consumer Product Safety Act
(15 U.S.C. 2051 et seq.) and Federal Hazardous Substances Act (15 U.S.C. 1261 et seq.) respectively, where the employer can show that it is used in the workplace for the purpose intended by the chemical manufacturer or importer of the product, and the use results in a duration and frequency of exposure which is not greater than the range of exposures that could reasonably be experienced by consumers when used for the purpose intended.
OSHA has consistently taken the position, in various rulemaking documents and interpretation letters, “most office products (such as pens, pencils, adhesive tape) to be exempt under the provisions of the rule, either as articles or as consumer products.” Markers also fall into these exempted categories. This position is cited currently on OSHA’s website in a letter from OSHA Assistant Secretary John A. Pendergrass to U.S. Congressman Jim Bunning. These examples are cited again in OSHA’s FAQs on the Hazard Communication Standard which further reinforces that Newell- Rubbermaid writing products are exempt from Hazard Communication requirements, specifically GHS Safety Data Sheet documentation.

I think the Hazmat is justing trying to stay employed. I see they often mark stuff as hazmat that is not hazmat, which I suspect is just part of Amazon Metric Madness. Like cops and ticket quotas.
Of course they will totally ignore real hazmat like Canon Fuses, lead foil, and Naptha - I am pretty close to contacting some of those Prop 65 bounty hunter lawyers on a few items like “permanent matches” which contain Naptha and should not be stored FBA unlabeled as hazmat or shipped by air.

Might as well write your own. Take a product that has an SPS and modify it for your sharpie. That way, it’s no longer a dangerous weapon.

Does anyone know if providing the SDS for permanent marker will allow the product to ship air through FBA? Our listing was just nailed with hazmat yesterday and have 10 day estimated delivery time…and of course they are time sensitive - zero sales with 600 clicks since designation yesterday. All inventory is obsolete in 5 days…FML.
Even with proper SDS sheet, will permanent markers / sharpie pens still not be allowed to ship air / 2day prime?
