Long Time Amazon Seller Suspended Under Section 3 – Incompetence or Unfair Treatment? Need Mod Help!

We never imagined we’d need to post here, but after exhausting every avenue through Seller Central and appeals, we are in urgent need of help to resolve an undeserved account suspension that is threatening our livelihood.

We’ve been selling on Amazon since 2015, and even today, our account health dashboard still indicates "healthy." We’ve never had any issues or violations, and we've always followed Amazon’s policies closely.

Our account was recently suspended under Section 3 of the Amazon Business Solutions Agreement, citing concerns about product authenticity. However, we have fully complied with every request from Amazon and provided all the supply chain documentation, including bank statements, invoices, and proof of delivery. Despite this, our account remains suspended, our funds are frozen, and we are unable to ship any products.

To make matters worse, Amazon is currently holding $200,000 worth of our inventory, and we are being charged Q4 storage fees for products we are unable to move. This is adding a significant financial burden on top of everything else, and we are deeply concerned about the future of our inventory.

On top of this, my family and I are in the middle of building a new house. We also built a new warehouse that we moved into 2 weeks ago while the home is being finished. The new warehouse is of course to grow the Amazon business, and now here we are.... If our account is not reinstated soon, this situation will leave us financially and emotionally devastated. Amazon has been our primary source of income for years, and we are at a complete standstill. We just want to get back to serving Amazon's customers well, supporting our family, and all the clients and service providers that depend on the income generated.

It’s also worth mentioning that, on this specific ASIN, Amazon has recently come onto the listing. Is this a coincidence?

We are reaching out here in the hope that a moderator can escalate our case for review. We’ve done nothing to violate Amazon’s terms of service, and we’ve been in full compliance from the beginning. We just want to get back to running our business and supporting everyone who depends on us.

Thank you in advance for any help you can provide,

[Moderator Edit: removed personal information]

How long ago were you suspended? Did Amazon respond to your submissions?

FYI, I received a suspension out of thin air the first time I listed something that Amazon was also selling...it took 7 months from the sale of the single item for Amazon to suspend my account.

What are you selling? Are your invoices from a distributor or wholesaler?

1 week. Yes they have responded that the documents do not meet their criteria. I purchased 700 of these units and have sold through 640 units in the past 18 months with a return rate of about 2%. I've received no customer complaints regarding this ASIN.

"It’s also worth mentioning that, on this specific ASIN, Amazon has recently come onto the listing. Is this a coincidence? "

Possibly, possibly not. However, @Seller_OvL8C4BJWiuS9has tried to lead you to the more likely problem.

I see mentions of invoices, authorized wholesalers, and so on but what is MISSING is any mention of an LOA from the brand. NO WHOLESALER can grant you permission to sell products. The LOA must come from the brand!

Amazon has changed the requirements for selling over the past year or two and all you need to do is read the Forum every day to see the dozens/hundreds of posts about suspensions for selling brands that they have sold for years (in some cases).

There are two important questions that you need to address these days for selling on Amazon --

DO YOU have an LOA from the brand allowing you to sell on here?

DID YOU source from AUTHORIZED wholesale sources that your rep at the brand says are OK?

If you don't already have these in place you are probably going to have stranded inventory and a suspended account.

For any rookies out there reading this, please take the following information into account so you don't end up where the OP is!

HINT #1 -- VACATION MODE -- NOW!

HINT #2 -- SELLER U -- NOW!

https://sell.amazon.com/learn

HINT #3 -- Start writing your "please help with my Section 3 suspension' letter NOW. It will save you time when you get it.

Pay attention to this recent story in the Amazon 'news' from September 25, 2024.

Sellers were given a 5 day warning that this was being put in place. Sellers have posted that LOAs are required in Europe, so you can see the handwriting on the walls -- this is coming for EVERYTHING on Amazon eventually!
