Counterfeit seller are increased on Amazon

Hello,

Nowadays I fight with counterfeit seller on my listings. Amazon has just one tool that is "report violation tool"

I think that "report violation tool" just helping to counterfeit seller, just gives them more time to sell their fake products. And then they left from listings.

I have trade mark from USPTO, I have brand registry what Amazon advice, what is result ? I feel just stupit. Any counterfeit seller can list any "fake product" under my listing.

If Amazon will not protect us who will do this?

Amazon has a counterfeit problem that is larger than anyone can imagine.

I just finished removing 134 sellers from the platform. I am not exaggerating that number. It was exactly 134.

It was for a branded hair dye product that a supplier in 1688 copied to make it look identical to the branded hair dye product. The reason I know this is because I retracted the complaint I sent for the seller that told me all of the details.

I will do everything in my power to aggressively protect honest sellers such as yourself, but I fear this problem has grown to a level no one can imagine due to Amazons platform. Its incredibly easy for these counterfeit sellers to unload their inventory and rationalize their unethical behavior by hiding behind Amazon policy.

I see your are based in Turkiye. I have viewed all of your listings. I do not see any of these sellers on your listing right now but I can offer you some tips for the .COM website for when they come back (I cannot help with other markets).

1. Your trademark was filed on 28/10/24. What this means is your trademark is not registered yet (it take about a year to register) and you will have to rely on copyright claims if these sellers come back on your listings. Therefore, I recommend making ANY website and ANY social media. Obviously, this will help your brand in the long run. But it will also protect you from counterfeit sellers on the USA marketplace. USA law dictates that you own the copyright as soon as the brand is used in eCommerce. Its true that you are already using this on the Amazon platform but Amazon likes to see it in other areas too....even if you are not generating sales in other areas. Unfortunately, you must do a test buy if you opt for this route. Typically, counterfeit sellers take 30 days to actually send the item to the United States so you will have to wait a while. I suggest you speak to a friend in the United States so send the counterfeit item to and have them send you pictures when it arrives. You can also try returning the item for a full refund but, since its merchant fulfilled, you will have to generate a label back to the country it came from. This can be unappealing....to the point where you can just have your father throw the product out instead like I did.

2. If you receive a DMCA counter claim, that seller has given you permission to sue them even though the counterfeit seller is international. This is a massive opportunity and I suggest you do everything you can to sue the offending seller if this happens....even though it will cost a couple thousand dollars. You will recoup that money and then some. Amazon now acts ad a mediator who holds onto money for any awaiting judgements.

3. You can also look into filing something known as a "temporary restraining order" but you will have to have an attorney do it and it might not be appealing cost wise. But if you get a copy of that restraining order and send it to Amazon....its virtually an automatic suspension for that seller.

I'm sorry that you are having difficulties with reporting other Sellers you believe are violating Amazon policy. In general reporting using the Report a Violation tool is the appropriate path, however if you have a fully registered Brand with a Trademark that is fully registered you can also report via your Brand Registry Account.
