Account deactivated due to "Restricted Products" Policy

Account deactivated due to "Restricted Products" Policy

My account was deactivated over 30 days because Amazon indicate that I violated their "Restricted Products" policy by selling a hearing aids without FDA approval. They told me that the device is a medical device which is for professional use. However, it's not true. My product is not a hearing aids. It's a hearing amplifier which can be sold over the counter and don't need any paperwork.

I submitted multiple appeals, provided so many proofs from the FDA website to prove that I'm eligible to sell the hearing amplifier. Even when a Account Health Specialist review my appeal, he said that it was good and I should be fine, my account will be reactivate after the internal team review it. But a few days later I received an email from the Performance team saying that my account will be kept deactivated because I fail to prove them that I didn't violate any Amazon policy. I submitted every proofs that I can find, and the Performance team don't tell me exactly what else they need from me. I don't know what they want to reactivate my account.

Has anyone have the same issue? and how did you get your account reactivated? Can someone from Amazon tell me what else I need to do?

As you mentioned the concern seems to be related to our medical device policy, this policy does indicate that Personal Sound Amplification Products are allowed.

With that being said I want to inquire about your listing itself, if the product complies and you can offer proof, are there other concerns with the listing?

Are you the ASIN creator, if so was this listed in the correct category upon creation? Are their mention of the product being a hearing aid in the detail page?

An appeal is not typically accepted for restricted product violations. We may occasionally accept an explanation in very specific scenarios, if your explanation can further support proof of compliance and that this was in error.

Can you advise what specific information you provided when you made your last submission? You mentioned providing FDA website, what page did you send them?
