Brand Registry Hijacking: Amazon's Policy Issue, Rogue Amazon Employee, Systems Issue or Loophole?
Two (2) months ago. Our Brand Registry was hijacked:

Here's some background: We registered, for the purpose of discussion, XYZ with USPTO in 2014. To date, XYZ trademark is still active. In 2018, XYZ was approved by Brand Registry. For more than 10 years, we are the sole seller of XYZ-branded products.
Here's what happened: In early 2024 (just this year), a company (say, ABC) based in the UK registered "XYZ" trademark with the UK Trademark Office. Their UK trademark application was approved. ABC then applied for Amazon's Brand Registry. We are not sure whether ABC's Brand Registry application was approved or rejected. But for some reason, ABC was able to take control of our XYZ brand registry and they were able to remove our access.
In July 2024, we opened a case (Case ID 15584268571) with Seller Support. The case was then transferred to Brand Registry Support who, after several days, determined that we are the rightful owner of the XYZ brand. We had to go through the painful process of having our store access restored and brand campaigns re-activated.
Two months later (1st week of September 2024), the same situation happened again: our brand is still active but unable to log-in to Brand Registry. We opened a new case (Case ID 15948431411) on September 2, 2024. It's now, September 4 and the case is still being investigated.
We can only surmise that ABC is able to take control of our Brand Registry again allowing them to remove our access.
This is a very serious issue. This is also data breach. ABC must have acquired sensitive data related to our brand.
Here are our questions:
1. When this Brand Hijacking case happened two months ago (Case ID 15584268571) and was reported to Amazon, did Amazon support just help us regain our Brand Registry control but did not do anything to prevent this situation from happening again? Was this situation escalated and discussed by the Brand Registry Team who did something to make sure this does not happen again to any brand owner?
2. Did Amazon approve the Brand Registry application of ABC (UK) company for the XYZ brand? I am not sure if Amazon's policy allows this (i.e., same brand but different owners by country?).
3. If the answer to question 2 is "yes", should the Brand Registry of our company (US-based) have been separated from the Brand Registry the ABC company (UK-based)? Is Amazon's system able to clearly separate the two (2) Brand Registries?
4. Did ABC company manipulate Brand Registry support (by presenting their UK Trademark) for them to get access to XYZ brand registry? If they did, this is a serious loophole that can be exploited by foreign companies.
5. If ABC violated Amazon's policy, what did Amazon do to ABC's selling account?
6. Does Amazon have a rogue associate who helped ABC company take control of another company's Brand Registry using a seemingly valid supporting document (i.e., using the UK Trademark)? If there's a rouge Amazon employee who helped ABC hijack our brand, what did Amazon do to the employee?
7. Once ABC company gained control of XYZ Brand Registry, they removed our access. Hence, we lost control of our Brand Registry. What sensitive data did ABC company steal from us?

Apparently not, or, as you speculate, rogue employees were involved. Nightmare scenario for brands trying to protect their IP and follow Amazon's rules.

My name is Dougal from the Community Manager Team and thank you for providing the extensive explanation and case ID's (past and current). This all really helped me ID what is going on and I have submitted a request to split the brands.
I will attempt to answer some of the questions you asked, but from what I have reviewed, this is 2 legitimate brands who each entered into the Amazon Brand Registry Application process, but somehow resulted in 1 brand being created with both sellers on it instead of 2 separate brands.
Answers:
- Based on the case ID you shared, there is no reference to hijacking, just an incorrect TM added to the brand which was removed and then a transfer to the Ads team for a stores issue
- I cannot answer the first question, but the answer to your second question is yes, the same brand name can be utilized if specific parameters are met
