Read onlyHi there,
We have been selling on Amazon since August last year and two days ago we got a patent infringement notice from amazon and our listing got taken down.
The only information Amazon provide was "contact the patent holder for more information". Is that even legal? They provide no proof, nothing other than contact the patent holder.
What if the patent holder doesn't want to talk to us? or don't want to say anything? Are we out of luck since Amazon is not giving us more information about the infringement?
We already scheduled a few calls with a lawyer but I'm trying to understand what is going on and how the whole process works.
Any help is appreciated
"The only information Amazon provide was "contact the patent holder for more information". Is that even legal? "
YES, it is legal as long as the people filing the complaint legitimately own a patent. Have you checked or verified the patent claim?
Normally at that point Amazon gives you the name and contact information for the party that files the complaint.
I have had a couple over the past 14+ years and contacted the people involved. In both cases they determined that I was an authorized seller of legitimate products.
Because I purchase under one LLC name and sell under a variety of different LLC names neither of them had recognized the seller name. My problems were rescinded.
Where did you source your products from? If it is ALI#@##@, they are well known for selling knockoffs and items that violate IP conditions.
