Counterfeit Sellers on Branded Listings Again
3 months ago, for 7 weeks we had 41 counterfeit sellers on our top 4 branded listings. This was a very organized targeted attack. Eventually they were removed. Some of the advice we received on these forums apparently upset Amazon. As exclusive seller with Partnered Agent designation by the brand in Europe, I contacted sellers. I've been told, no matter what I cannot do that, even at the direction of the brand. Fine. Report Abuse forms didn't work. Eventually escalation worked. Amazon's system and responses were very broken and inconsistent.
A forum posting from 3 months ago was very wrong about what to do and is still posted, including an Amazon moderator on the posting.
We have more counterfeit sellers again, apparently based in the US now and items being shipped by Amazon, but neither are showing as Prime. I have many questions as I think the Brand has been misinformed as to what they can do. there cannot be coincidence these showed up on the same day.
1. How can a product ship from Amazon.com and not be prime? I've placed test buys and waiting still but ship times are very long....7/24 for one order and the other says July 29-Aug 12.
2. Can I request a Bin Check on their inventory to confirm it is branded or counterfeit? They are definitely not authorized distributors. My guess is the Chinese manufacturers of the nearly identical counterfeits are telling sellers to join our listings, or are the sellers on our listings, just with US addresses now.
3. As a seller of a long-standing brand, what are my options as a seller? I can test buy and try to report, which I'd do through the old closed cases. Can I report anything via the listings page? What else is within the rules?
4. I've heard from several people to have the brand have an attorney write Amazon legal to remove the unauthorized sellers. Does this apply to pending trademarks? There is Brand Registry in Europe and US trademark pending.
5. The brand / manufacturer now believes they are not allowed to contact the sellers directly with a cease and desist message. They did before and had no remfications for doing so. I think they are wrong about this. Can the brand write Cease and Desist messages to unauthorized sellers.
6. Can Transparency really do anything to help without trademark?
7. Any other ideas?
