Brand Registry requirements for permanently affixed brand name - Explained


One of the guidelines for Brand Registry enrollment is to have the Brand name permanently affixed to the product or packaging. In this post we will give examples and provide resources on what this means.

During the Brand Registry application, Amazon asks that you submit at least one image of your product or product packaging as part of the application. The submitted pictures will be used solely for the purpose of reviewing your application, and your customers will not have access to them.

Sellers can use their phone camera to capture clear pictures of your product or its packaging. Note that stock images, digitally altered images, or computer-generated mockups are not acceptable image types. Before uploading your image, ensure that it is not blurry and clearly displays your brand’s name. The Brand name on the product must be easily readable and match the exact trademark name on your application.


What does it mean by brand name has to be permanently affixed?

Permanently affixed brand names are typically added during production and can be printed, sewn, laser-etched, or engraved onto items. Stickers, labels, hung tags, or stamps are not considered permanently affixed since they can be easily added or removed after production.

Certain products such as furniture, jewelry, soft toys, wigs, and handmade items, might not have permanently affixed brand names. In these cases, the product’s packaging must have a brand name that is permanently affixed. Other products, like phone cases or clothing, can have branding included as part of the products themselves.

Do not upload images of your brand's logo, trademark certificate, or anything else that does not showcase your product or its packaging in this section, as doing so may result in rejection of your application.


What are the common pitfalls with Image guidelines

  1. Brand name is blurry and images are not clear
  2. Stock images are used
  3. The brand name was digitally altered into the photo
  4. The photos are too small and brand name is not clearly visible
  5. Seller attached brand name that can be removed easily. (Stickers, tags, etc.)

Tips for getting your images approved

  1. Upload at least 3 images of the product or packaging from different angles so you can clearly see the brand name.
  2. Take pictures of the products in your hand or on a table.
  3. The images must be actual photos of the products you are planning to sell under your brand.

Are hang tags considered acceptable proof for the apparel category? In certain instances, the brand name I'm seeking to register, like WARNER BROS, is exclusively printed on the hang tag, while the sub-brand (i.e. DC Comics) is displayed via the heat seal. I can provide images privately to illustrate this. How does Amazon's Brand Registry accommodate these scenarios?

Sandy, I have reported at least 5 companies for failing to do this on their package or their product. Some even sell a branded product claiming it is another brand name. Amazon has NEVER once taken action against the sellers or forced the item to be listed as Generic. Thus, what is the point of this rule if it is not enforced?

Sandy maybe you can help me. I've opened multiple tickets but this issue never seems to get resolved. My brand "MOOH" is registered with Brand Registry. I'm able to create a store etc.

Please visit anyone of my products, I've linked one below. You'll see instead of the text saying "Visit the MOOH store" it says "Visit the Generic1 store". I have no idea what "generic1" is. All my products have always been published with the MOOH brand.

Side note, if you are/have been selling your brand successfully, I would HIGHLY recommend getting your trademark registered with the USPTO. The entire process takes about a year now. It's not terribly costly but will also save you a lot of headache in the long run. Using the brand as a business name IS NOT enough to protect your brand and product.

The photo requirements are the same as required for a trademark registration. Realize that China pays its citizens to register U.S. brands as trademarks if they are not already protected. The USPTO has gotten better though catching fake product mockups and photos, and if they are not caught right away, once it gets to an examiner, they are often caught. But don't count on it.

don't see any affixed brand on it from the image but I couldn't say for sure. it like a random brand name using for generic item. I guess if the factory in china sells the item themselves then it would be easy to make any brands affixed to it.
