Urgent: Unauthorized Seller Hijacking Our Listing – Immediate Action Required
Dear Amazon Seller Support,
We are facing an issue with an unauthorized seller hijacking our listing, and we need urgent assistance. The hijacker is listing counterfeit products from China under our brand without authorization.
Trademark Status: Pending approval. Amazon's system currently only allows us to report by ordering from the hijacker and submitting images of the fake product. However, this process could take a month or more, especially since the hijacker might never even ship our order. This delay is harming both our brand and customers, and we cannot afford to wait that long.
Problem: The hijacker is selling fake products, misleading customers, and damaging our brand reputation. Since we are unable to report this issue via Brand Registry due to our trademark being pending, we request Amazon's immediate assistance in removing this unauthorized seller. We can provide invoices, product images, or any additional proof required.
Please take action as soon as possible.

Until you have a legally registered TM Amazon won't do anything (as you have found out so far).
Realize that IF your TM gets rejected for any reason Amazon could face legal issues if they take any action.
They will do what they need to do to protect AMAZON.
If you had waited for the TM instead of jumping in the river first you might have gotten some help (but even that is 'iffy' on here).

For an instance like this where you believe another seller is selling a product that is not accurate to the product detail page they're listing on, a test buy will need to be conducted to obtain proof of the products characteristics. If you find it is not accurate to the detail page, you may report this through Report Abuse by selecting "Products received are different than the description on the detail page".
