The allegations against this company and Amazon are all over the internet

So unless they copied it from the listings itself "they joined the ASIN" the issue becomes more complicated. Do any of the photos or images mention your brand or trademark informaton? Sadly they can crop photos and Amazon won't help much. You can however hire an IP lawyer , they charge about 250 bucks to write Amazon a letter and that should do the trick to at least get them to change the listing but if they aren't claiming it's the same brand, you can't stop them from selling it generic or under their own brand outside of if you bought it, saw your brand name on it and then you can actually do a counterfeit claim , state you do not wholesale and so the product cannot be authentic, and then supplying the evidence from the test buy. If they were under your ASIN you wouldn't even need to test buy.

After talking with patent lawyers it is clear that Amazon has a horrendous record of following US patent law especially when dealing with large Chinese retailers such as Vevor. Countless articles and media have evidence and allegations of Amazon working with such companies. Amazon has a record of not enforcing patent law regarding these companies who notoriously steal patented designs for knockoffs. Amazon also clearly lets such companies also break every rule in the Amazon terms and conditions
Please note that not only did this company completely follow our patent but they also stole several of our images 99%. It took me countless brand registry cases and escalations with Amazon to get Amazon to take down 99% stolen pictures

2. A review of the Amazon "Intellectual Property for Rights Owners" in the Amazon terms and conditions. Amazon needs to follow it's own terms and conditions regarding IP and US law
3. A safety review of the Chinese knockoff. The Chinese company claims it supports 200lbs. Even with superior steel, craftmanship, and overall higher quality this design is not engineered to safely hold 200lbs. Our engineers are more than confident that this Chinese company is lying in order to pretend to have a better product than ours even thought they stole our patented design
4. A review of the reputation of the company that copied our design (Vevor) and the countless media articles online about their reputation and their relationship with Amazon. As posted, the media has investigated this company that is notorious for IP theft and blatant abuse of every Amazon term and condition in the book
5. A review of all the times we tried to simply ask for help from Amazon. All communications have been documented. Amazon has simply shown negligence for not only Amazon terms and conditions but US patent law

I'd be very skeptical about any attorney who claims they can reliably stop patent infringement originating from overseas manufacturers—particularly in China.
A well-known company in our area developed a novel design of electromechanical consumer products. They effectively created a new market category on Amazon and experienced strong early success, backed by valid U.S. utility patents.
But within a few years, Chinese factories began producing copycat versions—sold through a rotating cast of overseas Amazon sellers, each rebranding the products under a different name.
Despite repeated enforcement actions, every takedown was met with more infringing sellers appearing shortly after. The Chinese manufacturers behind the knock-offs faced no meaningful consequences.
In our view, the only sustainable path is to keep innovating—and to avoid manufacturing in countries where weak IP enforcement makes product designs easy targets for theft.

Patent US D974,692S, referred to in the original post, is a design patent.
Our company holds both design and utility patents. According to our experienced (and expensive) IP attorneys, utility patents generally provide much stronger protection—but enforcing either type, especially against overseas infringers, would incur legal costs that could bankrupt our small business.
In practice, our patents—especially the design patents—mainly serve to deter U.S.-based manufacturers and U.S. brick-and-mortar retailers.
They’re virtually useless against overseas Amazon sellers.

The same thing happened to me Amazon is supporting the knockoff more than me probably because it is a much larger company and this knock off company has build there company off knocking off other products. They also copyrighted my images and only one of the images got taken down and there are still 5 other images that are ai variations of my pictures. Its so not fair I spent 7 years creating my products and designs and now the knock off is saying I am harming there brand and now my account is under review for deactivation. :(

Have you used Amazon’s APEX (Amazon Patent Evaluation Express) program? You have not mentioned that, neither has anyone in this thread.
From what I understand, you file a claim, the other seller decides whether or not to contest the case. If they do not, you win. Listing removed. If they decide to contest, both sides must provide a deposit for a third party patent evaluator. Whoever wins, their money is returned, the loser loses the deposit. If the violating seller loses, listing removed.
If anyone has not tried this, then I would check it out. Might be better than going to court and paying a lot of money.

What he couldn't achieve in 5 months was achieved in 12 hours because of an interested local TV investigative reporter.
My advice: hire a per-hour local media consultant with solid contacts and remain calm if you make it on camera (a beta blocker may help). Practice extensively ahead of time.
