Trademark misuse

The original registered brand name was SEHA****, but the employee accidentally added HOME to the brand name when listing them.

And it was being sold for several years.

But last week, several listings suddenly started to be flagged with Trademark misuse (SEHA****), and finally the account was suspended.

Even if I appeal that I am the trademark owner of SEHA****, it is useless.

It seems that they recognize SEHA**** Home as a different brand.

Can anyone here help please?

Thanks in advance

Kim

Registered where? In Brand Registry? In USPTO?

Now your listings are running with "HOME" and you would like to remove that "HOME" which would make your listings match your real brand name, no?

The system has seen that the brand in your actual listings is not the correct one:

So if you want to sell your brand WITHOUT "Home" you have to create new listings by taking a new UPC from GS1, of course attributed to your "Legal Entity" and to your real brand name - without HOME.

You have no other choice.

Thank you for the information provided regarding the recent issues you have encountered with the impacted ASINs. I know this can be concerning given the changes and impact that has occurred, so I do want to get you guidance. I have reviewed the information on the cases, and do see where our team is advising that the listings do need to be updated or authorization documentation provided showing the current brand name is licensed by the one included in the messaging.

You may have the option to remove the listing and update the brand information to address the violation, but we cannot guarantee that this will go through. If you remain unable to make updates to the listing details, the only option that you would have would be to create new ASINs for these products. I know this may not be the answer you are looking for, but I do want to ensure transparency with this process.

If you have any additional questions or updates that you would like to share, please continue to refer to this thread for support.

Best,

Atlas
