Hello,
Your account will remain deactivated. Your listings have been removed. Funds will not be transferred to you, but will be held in your account while we work with you to address this issue.

We’re here to help.
If you need help better understanding what is causing this, please search for “Intellectual Property Violations” in Seller Central Help (https://sellercentral.amazon.com/gp/help/external/201361070).
How do I reinstate my account?
Please provide one of the following:
– Proof of product authenticity (e.g., invoice, Order ID or letter of authorization). It must clearly prove that your products do not infringe on the intellectual property of the rights owner. Please submit this information, any other documentation, and a list of impacted ASINS.
OR
A plan of action with the following:
– Greater detail on the root cause(s) of the infringement.

( my new POA )
Dear Amazon,
– Greatder Detail on the Root Cause of the issue
- I wass sourcing these ( ****** ) products from a wholesale distributor (******.de) without first contacting the brand owners to receive authorizations to source these products on Amazon from this distributor.
- I did not have brand permission as an authorized reseller of ***** items. This was my mistake.
- I made this mistake of listing the products on Amazon because I did not fully understand the supply chain and sourcing process. I believed that you could sell trademarked products on Amazon as long as they were authentic. I did not know I needed brand authorization as well.
- I cannot verify that I have a letter of authorization from the brand. Following the report from Amazon, I have contacted the supplier, and they have confirmed that the products are authentic, but I needed to contact ***** to ensure I was allowed to resell their products on Amazon.com. This was my mistake, as I should have confirmed this.
- Please note that as soon as I was notified of these concerns, I immediately addressed them by completing the following process:
- Identifying and permanently deleting the item from our Amazon inventory.
- Alerted supplier of the complaint.
- If provided the rights owner’s email, I contacted them directly outlining our actions and showing them our authorized supply chain.
– Actions taken to resolve this issue:
(1) I have deleted and removed my entire inventory, as well as any items with suspected or received infringement allegations. I am completely restarting my business with a new supplier.
(2) I have found a new supplier that sources me products with the appropriate brand authorization letters. This is how I am now sourcing my inventory.
(2) I have contacted ***** to let them know that I have removed all of their branded products from our inventory in order to resolve this issue,
(3) I have sought counsel to resolve the matter with the brand. I have contacted them and let them know of this issue. I let them know I am never listing or selling their products again without brand authorization.
– The steps we have taken to prevent the issue going forward:
(1) Before listing any items on the platform, I am checking to see if they are generic, trademarked, copyright or patented by doing a thorough research, including USPTO search, contacting brands and ensuring I have authorizations from the brand.
(2) I have conducted 3-day supply chain verification & intellectual property training for new and old employees, and the meeting was held from 10/20/2021 to 10/22/2021. Training material:
-
AMAZON ANTI-COUNTERFEITING POLICY (https://sellercentral.amazon.com/gp/help/help.html?itemID=G201165970&language=zh_CN&ref=ag_G201165970_cont_521)

CASE ANALYSIS: We have had each employee perform a case analysis of how to vet suppliers.
-
EMPLOYEES’ SELF-REFLECTION AND SUMMARY: We require each employee to submit a review of his / her daily work and a summary of his / her perception of the training after the training.
(3) Before purchasing any product – or listing on Amazon – we always confirm that the supplier is an authorized distributor of our products with the brand themselves by obtaining brand authorization certification in written form.
(4) We always have established policy-abiding supply chains. Our company has a thorough review and audit process for our suppliers including having them supply us the following:
Valid business license.
Proof of valid supply chain.
Contract to oblige with all US laws and Amazon policies.
We confirm that they are authorized distributors of our products with the brands.
In addition, we contact the Better Business Bureau to validate the distributor.
(5) We will only purchase from a reputable manufacturer and authorized distributors. Example:
We vet and validate our suppliers to ensure products are new, authentic and are allowed to be sold on Amazon.
We only use Suppliers that are referred to us by the brand rights owner.
We will verify with the brand if the Supplier is an Authorized Supplier.
Will always ask and obtain agreement between Supplier and brand; Standardize the transaction procedures and save the transaction voucher
We will make sure all our products are authentic and not infringing by implementing this Assurance Process.
Employees will be trained in the Assurance Process on a weekly basis. They will learn how to tell if a product is authentic or not. An example such as Total Quality Management, Models and standards, and Company Quality.
(6) We will get full authorization from the Brand owner of any products we want to list on Amazon and confirming the quantities we want to sell on Amazon. We won’t purchase from any Authorized Distributor without contacting the brand owner first to ensure products do not qualify for Trademark or any IP Claims.
(7) We have now an intellectual property research procedure in place. We will have an Intellectual Property Review Team of 3 (Including a temporary Amazon Seller Consultant) to search for all the pictures and words of the product we used whether it has registered a trademark to make sure they are not trademarked on the USPTO database: https://www.uspto.gov/patent and https://www3.wipo.int/branddb/en/. It will be a 100% check to make sure we do not infringe on intellectual property. We will not guess or make any assumptions about any potential violations.
(8) We consistently train and update our staff members every Monday on Amazon terms of service, policies and style guides, especially relating to listings. We closely manage and monitor our listing process and compliance regarding titles, descriptions, Conditions, and images. This is a proactive, preventive approach to avoid infringement complaints.
-We will train and review Policy with our staff every two weeks for 6 Months, then monthly moving on.
-Every two weeks we will review all policies of:
Product Detail Page Rules https://sellercentral.amazon.com/gp/help/200390640%202
Condition Guidelines https://sellercentral.amazon.com/gp/help/200339950

Best Practices in Product Authenticity and Quality
Prohibited Seller Activities and Actions
https://sellercentral.amazon.com/gp/help/200386250
(9). We review our inventory to make sure we are compliant with Amazon’s supply chain standards, infringement and intellectual property rights policies to prevent infringement complaints. Our company works to identify the issues and resolve them before they are a problem for Amazon or us. This may include contacting the “rights owner,” as required by Amazon policy.
Please help, any suggestions and idea greatly appreciated.

This has nothing to do with the root cause.
this would be under Action Taken.
Amazon is asking for greater detail, they are not asking for a longer POA, they are looking for specifics on what happened and that you have a good understanding going forward.
How did you find them, how did you vet them? Do you have invoices, can you supply them? This is an example of the “Greater Detail” that Amazon is looking for.
You have listed different policy’s, you need to provide some understanding with the policy’s showing Amazon that you have actually read and now understand them.
Your POA should not be longer that 500 words, you want to keep it brief but with great detail and easy to read and understand.
Seller_c3ob6yNYSLSEw
This is far too long, too wordy.
The Amazon rep who gets this probably scrolls through and sees the length then denies it.
Most have better results with a simple bullet pointed single page or less reply.
Keep in mind the Amazon reps who must read these often do not speak English natively which can make a long written out response like this difficult for them. Not to mention my understanding is Amazon agents are judged based on how many cases they reply to, not their attention to detail.
Try shortening and summarizing things as much as you can.
Theodore_Amazon
Hello, @topsellerss!
It’s me, Theodore, with Amazon!
I see you created duplicate posts for the same issue. Please refrain from creating duplicate posts as this can result in longer response times for yourself and for other sellers.
Last we left off, you were provided guidance on how to improve your plan of action. Since you are sharing your updated plan of action within this thread, we can continue the discussion here.
Root Cause:
I think there is some room for improvement in this section. @Medic really does say it best here,
I think your root cause is missing these key points. You state that this is a trademark violation. Which trademark? How is your product or listing infringing on it?
Additionally, your root cause states you did not fully understand the supply chain and sourcing process, but you also state the products are authentic. If there was a flaw in the supply chain and sourcing of your product, how are you able to ensure its authenticity?
Action Steps:
Are you taking their word for it, or do you have documentation to demonstrate that claim?
You state that your original supplier was able to confirm the authenticity of your products. Why was there a need to change your supplier at all?
Also, please note that letters of authorization need to be issued from the brand/manufacturer to you specifically. Authorization letters issued from the brand to your supplier or from your supplier to you are generally not accepted.
Preventative measures:
Overall, I think your preventative measures are fine. There is always room for improvement in all things, but there are no glaring issues that stand out to me.
I recommend providing additional detail in the areas I have pointed out before resubmitting. Let us know if you have more to share so we can provide continued support!
Cheers!
Theo
Edward_Amazon
Hi @topsellerss
Ed from Amazon chiming in to assist. Thank you for posting your revised plan here. I think @Medic has provided a lot of good feedback on your plan. I do believe your plan needs to be more clear in terms of specifics details on the actual issue and less repetition.
Let’s start with the root cause:
It’s ok to go straight to the root cause, no apology is needed and the relevant information posted here is also repeated in the actual section you posted for a root cause. This avoids repetition and ensures your plan goes directly to the issue.
These two points seem to be more aligned with a root cause.
This point is a bit conflicting; did you receive a performance notification? Did this complaint come directly from the rights owner? If you cannot prove the authenticity of the items then it is conflicting to inform that the goods are not counterfeit.
These are solid points as you are directly addressing any other issues arising from the same batch of inventory.
When did you set up this team? I would also advise moving this to corrective actions as it is an action item already completed. We can talk about their processes further in prevention.
This point lacks the how. What are the specific steps this team engages to ensure the items being sold through your account are sourced from a reliable supplier?
These points are unnecessary. You want to include steps that you will engage in rather than not
These are good goals but are also lacking detail in the how. What are the actual steps you will take to verify and ensure your sourced inventory can be tracked back to an authentic source?
Was listing products with inaccurate detail pages also the root cause? Your prevention measures should focus on addressing the issue that led to counterfeit or infringement complaints. If these were not the issue, then it is not necessary to point out these practices. As @Medic mentioned:
Overall, your plan will need to clearly identify the specific issue that led to the complaints so that you can elaborate on specific practices to address such issue.
Once you revise your plan, feel free to post it here for further feedback from the community.
Regards,
Ed.

You seem to enjoy repeating yourself in your POA. Amazon will not enjoy reading the same thing multiple times.
Example:
That is saying the same thing how many different ways? Pick the shortest and then abridge it, like “Listed branded products without prior consent of rights owners.”
- and -
See how you could make it much shorter, succinct and easy to read?

Oneida Castiel_AmazonEdward_AmazonMedic
please take a look at my revised POA , Here is an updated version:
Dear Amazon’s Account Health Support team
the root cause(s) that led to the infringement.
I received the following violation:
CATEYE is the rights owner who filed the copyright infringements report for the following ASIN: B007YV1GFQ
Title: CATEYE Velo 9 Wired Bike Computer, Black
ASIN: B007YV1GFQ
Infringement type: Counterfeit
-
I did not have brand permission as an authorized reseller of CAT EYE items. This was my mistake.
-
I made this mistake of listing the products on Amazon because I did not fully understand the supply chain and sourcing process. I believed that you could sell trademarked products on Amazon as long as they were authentic. I did not know I needed brand authorization as well.
-
I also failed to verify authorization with brands or notify them of my intended Amazon sales prior to listing and selling the products on Amazon.
-
I should have checked the USPTO and wip.int/branddb websites for brand and text registration by searching for the terms before listings the ASIN.
The actions you have taken to resolve the issue:
(1) I have deleted and removed ASIN B007YV1GFQ, as well as my entire inventory, as well as any items with suspected or received infringement allegations.
(2) I have contacted CAT EYE to let them know that I have removed all of their branded products from our inventory in order to resolve this issue, I let them know I am never listing or selling their products again without brand authorization.
(3) I have conducted a full investigation of Amazon listings to ensure that the products we are obtaining are in fact in accordance with the policies for Amazon, and I have also checked my entire inventory to ensure that all of my listings meet the Program Policy and Product Guidelines described here:(https://sellercentral.amazon.com/help/hub/reference/G521 2),
– The steps we have taken to prevent the issue going forward:
(1) Before listing any items on the platform, I am checking to see if they are generic, trademarked, copyright or patented by doing a thorough research, including USPTO search, contacting brands and ensuring I have authorizations from the brand.
(2) I have conducted 3-day supply chain verification & intellectual property training for and the meeting was held from 10/20/2021 to 10/22/2021. Training material:
- AMAZON ANTI-COUNTERFEITING POLICY (https://sellercentral.amazon.com/gp/help/help.html?itemID=G201165970&language=zh_CN&ref=ag_G201165970_cont_521)
-TRADEMARK USAGE Guidelines(https://sellercentral.amazon.com/gp/help/help.html?itemID=G200573210&language=zh_CN&ref=ag_G200573210_cont_521) I’m now clear as what an intellectual property is and the difference between Trademarks, Intellectual Property and Patents, and why I wasn’t allowed to sell the item as I didn’t have any permission to do so.
(3) I know now Before purchasing any product – or listing on Amazon – Make sure that the supplier is an authorized distributor of our products with the brand themselves by obtaining brand authorization certification in written form , and I won’t purchase from any Authorized Distributor without contacting the brand owner first to ensure products do not qualify for Trademark or any IP Claims.
(4) I have now an intellectual property research procedure in place. We will have an Intellectual Property Review Team of 1 to search for all the pictures and words of the product we used whether it has registered a trademark to make sure they are not trademarked on the USPTO database: https://www.uspto.gov/patent and https://www3.wipo.int/branddb/en/. It will be a 100% check to make sure we do not infringe on intellectual property. We will not guess or make any assumptions about any potential violations.
(5) We consistently train and update our staff members every Monday on Amazon terms of service, policies and style guides, especially relating to listings. We closely manage and monitor our listing process and compliance regarding titles, descriptions, Conditions, and images. This is a proactive, preventive approach to avoid infringement complaints.
-We will train and review Policy with our staff every two weeks for 6 Months, then monthly moving on.
-Every two weeks we will review all policies of:

https://sellercentral.amazon.com/gp/help/200386250
I have provided invoices and copy of mail contact with CatEye brand owner

Hello @topsellerss,
Darby from Amazon here to follow up on your plan of action and our response regarding the authenticity complaint. In the last plan of action you posted the root cause of the issue being:
I am focusing on your root cause because a right’s owner made a complaint regarding your product not being authentic. I do not see you specifically discussing how you chose your inventory or how you chose and verified your supplier. Just that you failed to do many things. What were your previous procedures? How will we know what you have specifically improved going forward if we do not know what you were doing before? Have you communicated what you learned here?
Have you actually addressed how your sourcing procedures specifically led to the authenticity complaint? As you stated you are not authorized to sell this brand and did not source from an authorized distributor, then unless you have provided a letter of authorization you need to reconsider continuing to argue that your product is authentic.
When I reviewed your plan of action I also noticed no mention of your listing procedures. Your preventative steps are pretty solid, but it helps to communicate a well-rounded understanding of how you can also be preventing authenticity and intellectual property complaints by ensuring your listing to be exactly matches the current product as well.
We are not likely to respond to any invalid appeals at this point in your appeal process. It is important to remember we can only accept the appeal being reviewed. So always make sure your plan of action has all of the relevant information even if it was previously mentioned.
If you post your revised plan of action here we can help you review it.
My best wishes,
Darby
