ASIN Listing Hijacked, Brand Changed

Hello,

I’ve encountered this issue several times in the past, and it typically requires escalation from a moderator for proper resolution.

Years ago, I created a listing under my brand to sell a trademarked item. Recently, another seller has changed the brand name on that listing. I contacted Seller Support, and they informed me that brand information cannot be changed - yet the brand name on my listing has been altered, and I’m now no longer approved to sell the item.

Five minutes ago another seller asked exactly the same thing. So, sometimes it's worth looking what others ask.... I copy paste my answer here:

Create a case with seller support and add two screenshots:

1. USPTO showing you as brand owner. Exactly as in your "Legal Entity" in your seller account.

2. GS1 search showing you as the owner who used this UPC to create the listing. Exactly as in your "Legal Entity" in your seller account.

These proofs are unbeatable and they will change the brand, but it can take some time.

And THAT ... my friends is the root cause. Fix THAT problem and all these other issues/complaints go away.

You talk to Amazon, isn't it? Because we seller can't fix anything. But you are right, the brand on a listing can not be changed according to the TOS, nevertheless we see that happen countless times on a daily basis.

I reviewed the ASIN history and specifically the brand name attribute that was used when the ASIN was created and it is not the same as the brand name you are requesting to change the ASIN to. Because of this and based on the Amazon Brand Name policy, I cannot assist in changing the brand name to what you requested.

Thank you for your post. I thought I was alone. I have a product that I manufacture and listed on Amazon many years ago before there was a Brand Registry. At the time we used our company name when filling in the brand name field on all 4 size variation ASINs. One of these size variation ASINs was later hijacked to another brand name. So then we had 3 variation ASINs with our company name as the brand and one ASIN with a fake brand name. We then received a new brand TM from USPTO for this family and Amazon accepted the TM into Brand Registry. After years and endless requests to change all 4 ASINs to the new USPTO TM, Amazon changed only 2 of of the 4, but not the hijacked one. Amazon in their infinite wisdom has said that is all they can do. The result is today, of 4 child size variation ASINs, 1 has the hijacked brand name, 1 has our original company name as the brand and 2 have to new USPTO brand. Amazon has said, our work here is done. Nuts.
