EPA FIFRA EXEMPTED PRODUCTS THAT WE CANT GET REINSTATED

Dear Sir or Madam,

We sell products that are exempt from the FIFRA Act, meaning no EPA registration is required for our ASIN numbers. We provided our fly attractant bait formula’s Safety Data Sheet, our labeling and directed the representatives from India to the U.S. federal regulations page that defines the minimum risk pesticide device, which is exempt from the FIFRA Act. However, our product listings are still on hold. Even though we are exempt from FIFRA, they wanted us to change the marking to indicate the device is a pesticide device, which we did last night. This morning, we received another generic response for the entire category, and our products are still not reinstated.

Our messages are not being read in our case logs. We receive one message per day from India. We would like to speak with an American representative who is knowledgeable about EPA regulations; we do not mind paying extra for this service. We now have 20 different case logs. In one of them, the representative told us that our products were being reinstated. When we inquired about the delay after two days, someone new responded and restarted the case log from the beginning without reading the previous messages.

If you could check the 90% of the asins, Made in China products dont even have any labeling on them, they still have their claims and they are active. This discrimination has to stop.

Good Evening @Seller_VspnjmcJwwyau,

I just wanted to check in on how the appeal process is going on your ASINs being flagged as pesticides? I saw on the latest case you had filed that you were trying to edit your bullet points on your ASINs.

I believe you update the pesticide markings through:

  1. Go to the Inventory tab, select Manage Inventory from the dropdown menu.
  2. Find the listing you want to edit, and select Edit from the dropdown menu for that listing.
  3. Select Advanced View and navigate to the Compliance tab to find the Pesticide Marking attribute.

More information regarding the process to update ASINs one at a time or multiple at a time can be found on this help page -->HERE<--

Hopefully that information helps. Please let me know when all the ASINs are updated in addition to letting Seller Support know that you have edited all the ASINs accordingly by adding the "the EPA number to the pesticide marking attribute for further reinstatement process."
