I'm being attacked by a competitor!

My competitor claims that I am infringing on his trademark. He got 5 of my listings suppressed.

I have two to three words in between his two words that make his trademark (I don't know if I can say the name here). As I said, I have two to three words in between what makes his trademark, and it is not done on my side on purpose to copy his trademark, but it is because it is really hard to describe my item unless I use one or two of his trademark name. He says it causes "brand confusion"

My brand is also trademarked, and it is in the brand registry.

I can understand that (maybe), so ok, now what? I go to "Product Policy Compliance" to submit my appeal, and it just says they need more proof that I "fixed" my listings! I don't know what else they want me to do??

Has anyone gone through this? Do you know what it is that they want from me?

Likely you have to take the words out. While that can't be done for the ASIN, you should be able to edit your SKU and provide that to Amazon as proof.

Without more info it's very hard to guess.

Post the original notice.

Remove the phrase "Unity Cross" any where it appears in your listing by doing this ...

From Amazon's examples, we think you would need to phrase it as "Wood Wedding Cross by Unity Braids" as this would eliminate and confusion. In doing this, it clearly defines the product in a way that there is no confusion. You could then submit your response to Amazon and add your brand including USPTO registration number.

Since you are registered with USPTO, you also have rights. A conversation with your IP lawyer may be helpful.

And fyi ... Unity Cross can not make a claim against the use of Cross just like you can not make a claim against the use of Braids ... both are noted in USPTO filings.

Same thing happened to us 4 years ago. Amazon suspended our account for 1 year over a competitor's false accusation. It was miserable, took massive losses. Had to hire an attorney. I wouldn't wish that experience on anyone.

HOW ARROGANT! Perhaps HE is infringing on YOUR trademark. Perhaps HE should remove the two words from HIS listing. Fight back. Fight fire with fire. Report THEM as infringing on YOUR trademark, causing brand confusion.

Take the words out now to get the products reactivated. Then get a lawyer to talk with their lawyer. about common ground.

This seems to be a common occurrence. I received bomb threats from a Chinese seller & Amazon barely did anything to resolve it. The seller is also still active which is ridiculous. My best advice would be to call in & ask for a supervisor. Also email Jeff's email as well.
