Children's sleepwear covered by this policy

Children’s sleepwear sizes 9 months to size 14

Children’s sleepwear is considered to be any article of clothing, including nightgowns, pajamas, robes, or loungewear, sized above 9 months to size 14 and intended to be worn primarily for sleeping or activities related to sleeping. Children’s sleepwear does not include diapers, underwear, or garments sized for babies 9 months and younger.

Children’s sleepwear is required to meet specific flammability requirements. Children’s sleepwear must either 1) pass certain flammability tests; or 2) be “tight-fitting” or “snug-fitting” as defined by the dimensions specified below.

Note: Tight-fitting sleepwear is still required to meet flammability testing for clothing textiles.

Tight- and snug-fitting sleepwear

“Tight-fitting” or “snug-fitting” sleepwear is made to fit closely against the body. This type of sleepwear will not ignite easily. If ignited, it will not burn easily, because there is minimal air under the garment to feed a fire. Tight-fitting sleepwear must meet specific sizing requirements set forth in 16 CFR 1615 (for sizes above 9 months to size 6X) and 16 CFR 1616 (for sizes 7 to 14). If the product meets the specific sizing requirements in either of the aforementioned standards, it is considered tight- or snug-fitting and does not need to be tested to the flammability requirements within 16 CFR 1615 or 1616. Tight-fitting sleepwear is still required to be assessed to and meet the flammability requirements set forth in 16 CFR 1610.

Tight fitting sleepwear must carry specific labeling. The product must bear a label on the center back of the garment that states “Wear Snug-Fitting, Not Flame Resistant”. The product must bear a yellow hang tag with the following information:

Product packaging must also include the label shown above, in yellow.
