California Proposition 65 - guidance for Prime Now sellers

This policy describes your obligation to provide us with Proposition 65 warnings and how those warnings will be displayed. Background information on Proposition 65 and how it applies to you is also provided below for your convenience.

How to provide Proposition 65 warnings for your products

For all products you currently sell or will sell on Amazon Prime Now, you have an obligation to determine if the product requires a Proposition 65 warning and provide the warning to us as required by California law and this policy. Even if your products currently contain a Proposition 65 warning label, you need to provide us with the warning that must be displayed online (See below for examples of permissible warnings under the new regulations). For any product that you do not provide us with an online warning by August 15, 2018, you agree no warnings are required for that product and no warning needs to be displayed online.

If your product requires a Proposition 65 warning, then you must follow the process below to provide us with the warning to be displayed online:

Use the attached Excel spreadsheet called the Supplier Prop 65 Input File. Go to the second tab, labeled Prop 65 Input.

Step 1

Review the highlighted columns. Each column corresponds to a type of information you will need to provide (for example, “item_sku”). Please go through steps 2 and 3 below before populating the columns for each product that requires a warning.

After reviewing steps 2 and 3, complete the spreadsheet in the Prop 65 Vendor Input tab. Begin by clicking on the empty row in Column B (item_sku) and inserting the SKU code for your applicable products.

For Columns GP to GV, click on the empty space and an arrow will appear. You will be able to select a value from a drop down menu.

Note: You can also choose from the sample values provided in the Valid Values Tab. See step 3 for more details.

For each applicable product, select the appropriate California Proposition 65 Warning Type and the associated California Proposition 65 Chemical Name(s), if applicable. Remember to provide the SKU (“item_sku”) for each product


Step 2

Review the Data Definitions tab prior to populating the columns in the Prop 65 Vendor Input tab, as it will provide helpful information. Each Field Name corresponds to a highlighted column in the Prop 65 Vendor Input tab. For example, “item_sku” means a unique identifier for the product, assigned by you.


Step 3

Click on the Valid Values tab to see a list of sample values you can use when populating the columns. You can choose from the drop down menu under each column (refer to the diagram in step 1), or you can use a sample value from this tab.


Important: In the rare case where a court ruling has required you to provide a specific Proposition 65 warning for your product, then you must contact your Prime Now Account Manager to provide us with such warning.

You may not provide us with a Proposition 65 warning in any other way (for example, by email) and you may not provide us with any warning materials such as labels or tags to display with your product unless we otherwise instruct you in writing.

California Proposition 65 warning types

If you select a Food, Furniture, or Chemical Warning Type, then you must also select at least one Chemical Name. You may not select more than five Chemical Names.

Chemical

For exposures to chemicals that cause cancer:

Warning This product can expose you to chemicals including [name of one or more chemicals], which is [are] known to the State of California to cause cancer. For more information go to www.P65Warnings.ca.gov/.

For exposures to chemicals that cause reproductive toxicity:

Warning This product can expose you to chemicals including [name of one or more chemicals], which is [are] known to the State of California to cause birth defects or other reproductive harm. For more information go to www.P65Warnings.ca.gov/.

For exposures to different chemicals that cause cancer and reproductive toxicity:

Warning This product can expose you to chemicals including [name of one or more chemicals], which is [are] known to the State of California to cause cancer, and [name of one or more chemicals], which is [are] known to the State of California to cause birth defects or other reproductive harm. For more information go to www.P65Warnings.ca.gov/.

For exposures to chemicals that cause both cancer and reproductive toxicity:

Warning This product can expose you to chemicals including [name of one or more chemicals], which is [are] known to the State of California to cause cancer and birth defects or other reproductive harm. For more information go to www.P65Warnings.ca.gov/.

If your product has one of the following on-product warnings printed on or affixed to the product or its container or wrapper, then you must select one of the following warning types:

If your product is an Alcoholic Beverage, Raw Wood, a Passenger or Off-road Vehicle, a Recreational Vessel, or includes a Diesel Engine, then you must select the relevant warning type:

Alcoholic Beverage Warning: Drinking distilled spirits, beer, coolers, wine and other alcoholic beverages may increase cancer risk, and, during pregnancy, can cause birth defects. For more information go to www.P65Warnings.ca.gov/alcoholic-beverages.
Raw Wood Warning: Drilling, sawing, sanding or machining wood products can expose you to wood dust, a substance known to the State of California to cause cancer. Avoid inhaling wood dust or use a dust mask or other safeguards for personal protection. For more information go to www.P65Warnings.ca.gov/wood.
Passenger or Off-road Vehicle Warning: Operating, servicing and maintaining a passenger vehicle or off-road vehicle can expose you to chemicals including engine exhaust, carbon monoxide, phthalates, and lead, which are known to the State of California to cause cancer and birth defects or other reproductive harm. To minimize exposure, avoid breathing exhaust, do not idle the engine except as necessary, service your vehicle in a well-ventilated area and wear gloves or wash your hands frequently when servicing your vehicle. Recreational Vessel Warning: Operating, servicing and maintaining a recreational marine vessel can expose you to chemicals including engine exhaust, carbon monoxide, phthalates, and lead, which are known to the State of California to cause cancer and birth defects or other reproductive harm. To minimize exposure, avoid breathing exhaust, service your vessel in a well-ventilated area and wear gloves or wash your hands frequently when servicing this vessel. Diesel Engine Warning: Breathing diesel engine exhaust exposes you to chemicals known to the State of California to cause cancer and birth defects or other reproductive harm.
  • Always start and operate the engine in a well-ventilated area.
  • If in an enclosed area, vent the exhaust to the outside.
  • Do not modify or tamper with the exhaust system.
  • Do not idle the engine except as necessary.

Background information about Proposition 65

Proposition 65, officially the Safe Drinking Water and Toxic Enforcement Act of 1986, is a law that requires warnings be provided to California consumers when they will be exposed to chemicals identified by California as causing cancer or reproductive toxicity. The warnings are intended to help California consumers make informed decisions about their exposures to these chemicals from the products they use. The California Office of Environmental Health Hazard Assessment (OEHHA) administers the Proposition 65 program and publishes the listed chemicals, which includes more than 850 chemicals. In August 2016, OEHHA adopted new regulations, effective on August 30, 2018, which change the information required in Proposition 65 warnings.
