Hello Amazon Seller Community,
I'm facing an exhausting and damaging situation that began approximately one year ago, severely impacting our business.
Background:
Over 10 years ago, I created an Amazon listing (ASIN: B00UQXBTC4) for our specialized youth sports product called "Wrist Coaches"—wrist-mounted playbooks specifically for flag football.
Initially, trademark registration wasn't mandatory on Amazon, and although I attempted to secure the "WristCoaches" trademark a few years ago, my USPTO application was denied due to a pre-existing registration by Under Armour ("Wrist Coach").
Current Problem:
Approximately one year ago, without warning, a Chinese company successfully registered the name "WristCoaches" with the USPTO, despite clearly using it incorrectly for knee pads rather than wrist-mounted playbooks.
Immediately after, numerous unauthorized sellers (primarily Chinese companies) hijacked my Amazon listing, selling incorrect and low-quality products. This resulted in negative customer experiences, damaged brand reputation, and significant loss of sales.
Actions Taken:
Provided unauthorized sellers with formal 48-hour removal notices, resulting in some temporarily falling off.
Conducted multiple test purchases, clearly documenting that products received were significantly different from the product described on our detail page.
Consistently reported violations and posted factual, compliant 1-star reviews. However, these sellers repeatedly managed to remove all negative reviews, despite our strict adherence to Amazon’s posting policies.
Trademark Update:
Recently, I filed a formal challenge with the USPTO against the Chinese company's incorrect trademark registration.
USPTO has acknowledged my challenge, issuing notice to terminate the Chinese company’s registration due to misrepresentation of the product category (knee pads instead of wrist-mounted playbooks). This termination process is currently underway.
My Urgent Questions to the Community:
Has anyone successfully navigated a similar hijacking scenario and managed to swiftly remove unauthorized sellers who repeatedly evade Amazon's reporting mechanisms?
What additional escalation paths or actions beyond standard Amazon Seller Support channels have proven most effective?
This ongoing battle is causing severe disruption to our business and brand, and I'm seeking your experienced advice to urgently resolve this issue.
Thank you very much for your time and help!
Chris
