I have had my account suspended and was asked to submit a POA to reinstate it. I have sought advice online and even an Amazon employee gave me some help on forums but still got rejected again today! I have included everything they asked for and cannot think of anything else to add?

Amazon does not give specific information of what they want when they reject these so no clue how to proceed?

I have included my 4th plan below if anyone has any advice?

The root cause of the issue
I understand that I have intellectual property violation complaint’s from other sellers which I take seriously and plan to fully address and propose a viable action plan to address this and prevent it from happening again.

1. I understand that I should have been more careful when listing an offer on an existing ASIN. Even though I did not intentionally post anything that I thought was trademarked by another brand, I do realize some of my products may have been unintentionally listed on some branded products that I thought looked like my generic product.

2. I lacked the tools and staff to examine each product in my inventory to see if any product had the potential of having UPC’s that have been used by other restricted brands.

3. I had listed offers that I had thought were “generic” and un-branded products but because they are visually identical to other products listed on Amazon my software automatically created an offer when bulk uploading my inventory file.

4. I am a fairly new seller and had not had a full understanding of the ASIN matching policy and how some brands might claim ownership of the brand name of visually similar items. I had some initial confusion over submitting offers on existing ASINS that appear to be generic products but in fact seem to be a branded item.

5. I did not do enough research to verify trademark registrations on USPTO

6. I was not careful enough to only buy products from reputable sellers who offer full documentation and permission letters for branded products.

7. I was not careful to review all UPC codes and other product details to ensure they are matched to only brands I have permission to sell and thought that all products sold to me with a UPC code automatically allowed me to sell this product on Amazon without previous permission letters.

8. I had not carefully checked my IP complaints on a daily basis to ensure I addressed each complaint immediately.

9. The past year has been very challenging due to staffing shortages and supplier delays due to Covid. Therefore, I have been at times understaffed and overly busy with managing to keep my business running as smoothly as it normally does.

The actions you have taken to resolve the issue

1. I immediately put my store on vacation mode and ceased all sales and shipped out any remaining orders promptly so I could take the time to investigate the infractions and come up with an action plan to make sure this does not happen again.

2. I immediately removed all offers on ASINS that were listed in the IP complaints and reviewed all my inventory to see if I had other products owned by the complainant. If so, I removed them completely and will not sell in the future.

3. I met with all staff and did a careful analysis of current procedures in place for selling on Amazon and reviewed all of Amazon’s documentation on IP complaints, including trademarks at: https://sellercentral.amazon.com/gp/help/201361070

4. I have carefully reviewed each complainant and which infraction they are claiming was made on their Amazon product listing. I also have carefully verified the complainants registration information on USPTO

5. Below is the results of my careful analysis of each IP complaint and what I have done to resolve the complaint:

(A) B07WVBXPNX and B07X32CH8D: Trademark Infringement asserted on by COOSOS company solely owned by Tian Guang Yu INDIVIDUAL CHINA No. 3039, Bao’an North Road Luohu District ShenZhen,GuangDong CHINA.

• Both B07WVBXPNX and B07X32CH8D ASINs are listed with the title:
  Stylus Pens for Touch Screens, COSOOS Pad Stylus Pen Replacement, Fine Point Stylist Pen for iPad Pro/Air/Mini, Tablet Pencil Compatible with iPhone 11 Pro Max/Samsung/LG, IOS/Android/Windows, Surface

• Company Registered trademark under COSOOS at: USPTO

• Conclusion: The company has not registered a trademark for what they are claiming as trademarked goods. They have not registered any Stylus Pens for Touch Screens and have no relationship to other brand names mentioned in their product listing on Amazon. Their trademark is exclusively listed for security systems and not styluses for Androids, iPhones, and other cell phones, as mentioned in their ASIN description on Amazon.

• All attempts to contact Guang Yu at COOSOS by have been unanswered.

(B) B07K8HY8LR: Trademark Infringement asserted by Fujian Zongteng Network Co., Ltd limited company (ltd.) CHINA 4F, 5F, 6F, Laoguang Comprehensive Bldg. No.112 Laoguang Vill., Jianxin Town Cangshan Dist., Fuzhou CHINA 0086

They have not trademarked: “electric fireplaces” and have no relationship to other brand names mentioned in their product listing on Amazon. This company has no registered trademark covering these goods.

5. Even though I received no response from any complainant I took the proactive steps to reach out to each one and offered my promise not to list any products in the future, without consent from them. I also advised them of the steps I immediately took to resolve these issues.

6. I immediately had a staff meeting and determined what we could do better to prevent this from happening again and to determine if we have the tools and staffing to address all these issues.

The steps you have taken to prevent the issue going forward

1. I will never list any products or make offers on existing ASINS in which a trademark appears and I do not have written permission from the trademark owner.

2. I will only buy products for resale from reputable suppliers which can provide full documentation, which includes permission letters from brand owners.

3. I have implemented new procedures when selecting and listing products on Amazon which include: checking all brands and trademarks goods and services listed on USPTO, removing any products we do not have written permission to sell from the brand owner.

4. I have hired a new staff member to carefully monitor all listings and approve all inventory before listing on Amazon. This staff member will also check our health status on a daily basis to ensure we address any issues within 24 hours.

5. We will begin to list our own brand items and register our brand with USPTO. We plan to phase out other brands from our inventory and offer only our brands, which will avoid any IP complaints in the future.

6. I have purchased new software that will allow me to check existing inventory which will allow us to easily check each product against existing registered trademarks. Once we determine the brand of the product we will ensure we have proper documentation to make offers and if not we will dispose of these products.

7. All our staff are informed of these new procedures and have agreed to be vigilant in regards to making sure we never list another brand’s product without written permission.

8. I will not list an offer on any product where a brand is listed under the ASIN information. If our product is a generic products we will ensure we do not simply match it to a visually similar product.

9. I will check all future products to identify if they are branded and if so do research on USPTO to identify what goods and services are trademarked by the brand owner and ensure I have full permission to sell their product before listing on Amazon.

I take full responsibility for this situation and promise to practice all the methods mentioned to prevent this from happening in the future.

I hope this information clarifies how I guarantee this will not happen again and that you will allow me to continue being a seller on Amazon. I feel have learned from this situation, making me a better Amazon seller in the future.
